    Angel. You will not "lose" it, but if you do nothing they may TAKE it. You need to argue your corner - the link previously posted shows the legislation and guidelines that the ORs must adhere to. Take the bull by the horns and do as has been already suggested by writing/emailing them and telling that you have checked the rules and they cannot take it.

    If you do nothing the money may well go.

    These people are not gods. They are not the be all and end all - they are just adminstrators for your "estate" and you can question them.

    What they say will go though if you don't question it. We've seen a few people on here question things and it went in their favour. Don't worry if its embarrassing - you don't know these people and a little discomfort may buy you what you want.

    Did you have a look at wisebuyers website too as i find Parkers values are sometimes on the high side and they are target prices so knock off at least 10% for probable selling price.

    The thing is if they take your car they will only sell it on at an auction so will only get aout 50-60% of the street price and it will also cost them £500+ in agents fee's to collect and sell it. Some OR's are complete idiots and seem to take peoples vehicles just for the hell of it, i've heard some people lose cars worth only a few hundred quid.
    Life is like a game of Snakes & Ladders, i almost made it to the top but now i'm at the bottom again and its a very long ladder to the top. I had it all and now its gone :eek:
    Well my 6 years are now up, now to start to rebuild my life again

    I know how you feel. I was worried to death that they were going to take my step-daughters compensation (for injuries) because I was a trustee on the account. We couldn't find the original paperwork from the criminal compensation board so I was worried that I wouldn't be able to prove it wasn't anything to do with me and we were talking £24k (at the start of BR), so not peanuts.

    My Underling suggested that they may take it at my interview. She didn't know what she was talking about, but it didn't stop me from worrying for months afterwards. And if I hadn't mentioned it at my interview, they would never have known.


    Anyway, to cut it short, I provided evidence that I was only a trustee on the account and the account was in SDs name (a copy of the tax statement) and they left it at that. I was worried about it every time we took money out over the last year - I was worried each time we went into the branch that they would tell me the account had been frozen (never did!).


    Just because you know they can't touch it doesn't stop you from worrying! But fighting back makes you feel a whole lot better.
  • Yes, If i hadnt have told them they may never have found out but i am honest so i did. She said she wasnt 100% sure that they would take it she said she thinks we keep the loss of earnings and they take the injury part but I think she got that wrong? its the other way around as people have told me on here. I ma a worrier by nature and i cant change that. I didnt expect it would be easy.

    They are saying my car is exempt from them taking but if over 2 grand then money has to be found.

    Got how did my life get like this..... SINGLE, BR, AND SAD

    But yes i did get my gorgeous dog Murphy xx
