Finally bankrupt and interveiwed, but someone please tell me if they experienced this

    I would definitely ask for a breakdown of what she has and hasn't allowed on your SOA. Even taking out Sky and the extra £10 for 2 contents insurance there still doesn't seem to be any surplus to me so she must have disallowed other things.

    If it helps - in our first interview the OR mentioned an IPA of £160 per month to me :eek: I promptly burst into tears and asked him to look at it again please because I had NO idea how he had come up with me having £300+ per month 'surplus'. It was NEVER mentioned again :confused: and I did not get an IPA and we are now discharged. So don't lose hope just yet okay? :)

  • Thank You for that. I have just realised that my internet is 15.00 per month and landline is 11.50 per month. she was really hard on me. i am so worried as i have no surplus anyway. It is supposed to be anything over £100.00 you start to pay anyway???
  • also are they allowed to take mileage into the budget when it is not guaranteed

    here is the IPA table, I don't know about the mileage allowance though, sorry.

    Sorry also that you are having a difficult time with your OR, she does not sound too clued up about the whole procedure, if she is not the actual OR and is still being difficult about things, you can ask for the actual OR to review your case.

    Please try not to panic.

    Bear in mind that you will not have spoken to the actual OR. Look at it a bit like a big business, with the OR/Chairman at the top with managers and then the workers underneath. You would have spoken to one of these workers - an assistant or Underling, just as you with a large business; you never get to speak to the head guy at the top.

    My "Underling " barely knew her job. I ended up telling her stuff that she didn't know. She was obviously new to the role, and so may yours be. I mean that someone who knows what they are doing, will not act confused over whether or not they can take your compensation - they know.


    Email them. Start by thanking them for their time, but there are a few matters you want to clear up. Start with the compo. Tell them that as you were both confused about the matter so you went to check, as you are sure they have too, and would like to confirm that according to xyz, the money is for injuries and cannot be taken. Get yourself onto Parkers and look up your car for its value - then confirm in the email that you have done this and that the accurate value is xxx (hoping less than £2k!) Finish off with the fact you are very concerned about their calculations for the IPA. State that you do not have any surplus left from your SOA, so ask them please to let you have full details of how they have come to a figure of £50 as you cannot find the £99 surplus required to reflect this.


    Also bear in mind that they have targets to met too. It is possible that they are trying a nominal £50 IPA to see if you query it or not. Because if you don't then you will end up paying it.

    Cant help but worry! im maxed out on my wage, my car is needed for my job and the injury claim is the only money i have in the world.

    Where are you guys quoting this information from??

  • I am going to be having a similar argument with my trustee soon, I need my car for work its value is £1.8k my trustee has told me its more than he allows and he will be asking me for a contribution to it, maybe £300, I have read something about 2k? and mine falls under that.. but i have also read something regarding £500 for a car? im getting confused now.

    They won't let you have an allowance for sky TV, and I'm not sure about mobile, internet, and holiday either (but others may confirm this)
    It seems that some ORs don't allow for any of the above but some allow for internet and holiday. Mobile can certainly be allowed as 'phone' because some people don't have landlines these days.

    I was declared Bankrupt in December 2008. Had OR interview in January 2009, it lasted one & a half hours, he was very kind & understanding. The OR has let me keep my car, worth approx £2,500.00, I said I needed it to look for a new job. Going to Court was the easy part, but I was terrified of the OR interview.
