    I know this is digressing a little, but does the same rule also apply if someone is overpaid tax credits then? Can they only be 'asked' as the money will have been spent in good faith?

    (Not me by the way!)

    Been in the tax credit overpayment situation and they stopped my tax credits until overpayment was recovered. Was their error due to them mis calculating in the first palce and I got no say in it. Even had MP involved but nothing he could do

    Tax credits works differently to all other benefit types of overpayment - if official error on all other benefits it is not recoverable although they can ask for it back. Tax credits get it back regardless.
