CSA have over paid me

    im sorry that you are in this situation, however you maybe subject to situations of many nrp's and asked (forced) to pay it back within 2 years. which maybe a little leaway for you.

    As it is a PWC she will be ASKED to repay it, but not forced. It has no bearing on the NRP as they will have to be refunded also - so it is actually the taxpayer who picks up the bill in the end.

    isnt that a bit bias Kelloggs ? - PWC gets ASKED to pay back but NRPs have too ?

    and why arnt NRPs reinbursed payments paid from birth of those children who they find years down the line arnt theres?
  • pwc gets asked as they received and spent an over payment in good faith ie believed they were entitled to it.
    nrps have to pay to support thier children, its not actually paying anything back? unless of course they didnt pay for a while so got arrears!?

    nrps have the option to dispute paternity at the start of a csa case, its up to them if they agree the child is thiers and cannot be blamed on the csa!

    Just as NRP's are expected to put money aside to pay child maintenance then the OP should not have spent the overpaid money!

    I doubt thats right, £1000pcm in maintainence!!? :confused:

    there is a new query on here whereby a man has been paying maintannce for 10 years and has paid over £30,000 for a child which he has just found out isnt his, will he get that back ?

    Surely the nrp knew the children had left school and were earning (assuming they had contact with their children)

    So what! Not the NRP's fault at all.

    If the NRP has been paying the csa, and the csa forwarding the money to the PWC, then I would think that the csa and the PWC are jointly at fault.

    The NRP should get a full refund - had they not paid the CSA would have probably put on a DEO anyway, regardless!! The NRP has done the right thing, but it is down to the conscience and finances of the PWC as to whether she repays the money.
