Full & Final Settlement offered - typo on agreement letter

  • I don't know. My thoughts are if they had made an error on the letter they shouldn't of cashed the cheque - more contacted my mother and said "Error on letter, you actually owe us "x" please forward the total amount." Or something like in HSBC words!

    Of course they may have cashed the cheque and now be in the process of writing a letter that will request the additional amount - even though they have a signed document agreeing to their request for the amount on the cheque.

    If she hears nothing by the middle of March she's going to write to request confirmation that her accounts have been closed.

    Im sure some-one on here is more knowledgeable but i would think ,if the cheque is cashed then its binding as acceptence.Hopefully some one will come on and know for sure.

    Not, strictly speaking, legally binding.

    However, if the creditor was to attempt any form of action against this account she now has a letter stating this amount would be accepted in settlement and evidence that they cashed the cheque (one hopes) without comment or objection.

    I think she should now assume the matter is closed and not make further contact.

    The creditor would have to produce an agreement that such a huge debt existed.
