    People have given you their opinions one way or the other, some you agree with and some you don't. Fair enough, you've clearly decided what you're going to do.

    But as lal1234 said:

You've said that your damages are because as a result of the DP breach you split up with your OP and suffered financially. You'll need to prove causality - i.e. that the breach caused you to split up. How are you going to do this?
    Please just tell us calmly how you're planning to do this? Otherwise your case is extremely weak.

    So are you prepared to spend £5000 in legal costs and lose? That seems to be what you are saying. Or £20000 and win, but still be left with a £100 award and no costs because the court regards you as a vexatious litigant?

    To me it seems a trivial breach of the DPA - if they had just said who they were (hardly a breach??) it would have had just the same effect and they've really done very little more than that.

    I think ive seen the end of this thread so feel free to comment ive sent in an email to [Removed by Forum Team] , i did ask a question i did not ask for judgmental comments and scrutiny how im going to proove my case. I think thats irrelevant now given the manner of which people have treated this post on here. Most of you are actually a tad out of order, i am actually calm i dont feel the need to not be calm.:beer:

    negotiation prior to it getting to court maybe "another opinionated comment" please read the thread again things might become clearer, people are talking in terms of Court proceedings and thats not really what one has in mind but there u go yeh it seems i did say no matter what the cost figure of speech?

    Are you saying its OK to threaten to go to court even if you have no intention of doing so. Would this be consideerd an ethical stance?

    In accordance with the accepted principles of right and wrong that govern the conduct of this profession it is my personal opinion that it is ethical, people have actually gone as far as to take matters through the court system for less.

    Not sure if I've understood this correctly but it sounds like breach of the DPA is a criminal matter. Presumably the punishment would be a fine. Perhaps the bargaining chip for compensation could be around the likely fine the company would incur - rather more than £100 I would guess. Of course it would need to be discussed in a way where you couldn't be accused of blackmail.
    Sorry to hear about your relationship break-up. I suspect you would find it hard to prove that the DPA breach was the cause of the break-up that has subsequently affected your finances. I know when I've had break-ups, it's usually been "the straw that broke the camel's back" type of scenario and it can be very difficult to apportion in percentages which incident contributed how much to the break-up. If you go down that route, I feel it would be extremely difficult to quantify to yourself - never mind convincing a judge.
    Please don't take this the wrong way but if I was in a relationship that was brilliant and rock solid, it would take more than one act of financial awkwardness to cause it to break up. This is one reason why it could be so hard to quantify.
    Please read the above without thinking that it is judgemental. It isn't. I'm just genuinely trying to help.
    My layman's opinion is that if you want more than the £100 offered, you might want to check how big a fine the company would be likely to incur and pitch your claim a bit below that so that you can present it as a saving for them.
    My suggestions are free and free suggestions aren't worth very much - especially from a non-legal mind like mine :D
