Breach Of Data Protection

This is clearly a breach of the DPA which is a serious matter.
It would be very surprising indeed if the financial institution involved allowed this matter to escalate - they have clearly breached the DPA and will be looking to wrap this issue up amicably and quickly.
I do not think for one moment that they will allow this to go to court - so arguing about the potential final outcome of any court case is pointless.
This is just a matter of negotiation to reach a settlement satisfactory to both parties.
The company have offered their opening shot of £100 - this is the start of the negotiation not the final offer.
Judgmental comments about "the relationship" are out of order - it is none of anyone's business - the op was asking about the breach of the DPA.
Furthermore to suggest that "the Finance company has done the op a favour" by breaching the DPA is just a crass and bigoted comment that has no place here and it is the sort of comment that can put off future posters for fear of being humiliated or ridiculed.
Tinkerbell 84 - for a long term poster those comments do you no credit!
This site is all about helping and giving support isn't it?
The circumstances surrounding an issue are clearly relevant and comment without malice is perfectly reasonable.
Indeed in a great number of queries the surrounding circumstances turn out to be the significant issue and the original question the minor issue. OPs can just ignore comments they consider unhelpful.
In this case the whole thing is a little bizarre.
Here we have a law student who asks a very technical legal question on a bulletin board.
Now surely a law student would know lots of other law students and lots of qualified lawyers and have access to lots of law books.
Whilst there may have been a technical breach of the data protection act, its nevertheless routinely broken every day... and thank goodness it is.
In the last three weeks the follows breaches are noted
a. the local dentist phoned for my OH... so told me when their next dental appointment
b. a well known Insurance company phoned for my other half.. gave me a number for them to phone back on about 'their letter of complaint.'
c. Egg automated system phoned .. answered by OP but asking me to phone back.
Now any one of these breaches of the DPA could have led to an irreconcilable breakdown in my relationship causing emormous financial loss.
Should I sue?
Now we may have a troll or simply someone wanting to make some money.
Neither is that attractive.0 -

I agree with this point - my daughter is a law student, and when I had a legal query she was able to discuss it with a number of students, lecturers and a service run by the Uni offering cheap legal advice, and give me some unofficial advice. OP, I would imagine that this would be a better route to take than asking on a forum like this - although of course you may be taking this route too.0 -
Dont mean to sound rude tinkerbell84, but why the sarcasm????????i have posted for a very valid reason. I dont understand?????????
Hi
Have a look at the bathing thread in Families forum to see her high-handed attitude and water police approach.
I got so frustrated and have now deleted all my comments in that thread:rolleyes:0 -
I dont quite understand why majourity have jumped on the band wagon of like cyber bullying here??????? Laughing my tits of here Folks fair play to u all. I asked a question for a valid reason, your opinionated comments about my personal relationship break up which was consequently as a result of this really are irrelevant. What is relevant as per standupgye is the fact that thay have breached data protection. Yeh i am studying law but just because i do doesnt mean I KNOW IT ALL unlike the horrible minority on here(((got google and i know it all now)))))). I have conducted my own research along side posting on here i only posted as another option. Y do i get the feeling i am most bizarrly unwelcome on ere????????? I havent really done anything really but asked a question???????and i was hoping that some one with sound knowledge in this area would respond. Is there anything wrong with this????????also CLAPTON who the heck made u judge and jury with regards to my intention for wanting to persue this???? Dont you think its a matter of principle? What is Martyn Lewis's strapline "CONSUMER REVENGE" u must have misunderstood. By the way as i have already stated in previous posts it is not the money that i wont directly it is for the hire purchase company to reduce or take of the interest, i will be paying this off for a long time yet mate. So no i aint after money Durrhhhh which i the purpose of this site mind ???? Did you actually send off to get your PPI back i rest my case. Thanks standupguy by the way your a star. :T0

This place is full of so many judgmental people!!! The op has a valid question, the company has clearly breached DPA. I do not have an advice for you op but best of luck, please do not be put off posting, there are so many great posters too.0

So anyone who disagrees with you or doesn't give you the answer you want is boring?? ok then....
Breach of DP is a serious thing - though for compensation as said above you'll need to show damages of some sort. You've said that your damages are because as a result of the DP breach you split up with your OP and suffered financially. You'll need to prove causality - i.e. that the breach caused you to split up. How are you going to do this?
