Good post. Very informative.
1. Not sure she is correct though on the car being an asset. Can not see if it belongs to someone else how it can be your asset
. Would like to know the views on this from DD,ADTC and JSC1.
2. If they are thinking about imposing a BRU then a FTF interview is an almost definate.
3. The maintainance has been mentioned before, that they can not allow it if not through a proper legal channel.
Ah well lets hope all goes quiet for you both now.Dx
Oh dear, im worried now, i think i will ask the question on a seperate post!0 -
Oh sorry, as i said in your other post i did not mean to upset you. With it being your second bc i am suprised you did not get a FTF for this one as that seems to be the norm too. Regarding the car.
Here is MercMan's informative post from a previous thread. It is self explanitory and suggests that things are far from simple. When I split up with my now ex partner (known as the BFH - !!!!! From Hell) I had a problem with the car I drove. She had bought for me and it was in her name. She wanted it back I told to "Go Away" (or words that effect
). She then said I tell the police you stole it as its in my name.
I consulted my solicitor who said, "Do you tax it, do you pay for fuel, servicing, insurance and MOT?" I replied yes to all and he said "Its yours then". He went on to explain that ownership of a vehicle is a minefield. The Registration Certificate says "Registered Keeper" not the owner of it. In fact it says in the small print that "the registered keeper is not necessarily the legal owner" Various test cases have resulted in the only way the courts can determine the owner is by who pays to keep it on the road. Unless it is subject to a credit agreement e.g HP then the credit company is the legal owner until its paid for. This does not apply when the vehicle is bought using a personal bank loan.
He then explained that is why company car drivers have everything paid for them so they cannot argue they own the vehicle.
I use my private car for work but I pay for the fuel and claim it on petty cash from the company. Which means in law they have no interest in the vehicle.BSC No 248

All in all it doesn't sound too bad for a second BR. And probably not a bad as you would imagine it to be, it certainly doesn't sound as if they threw the book at you.Accept your past without regret, handle your present with confidence and face your future without fear0
