Advice about dismissal - please

    Thanks guys. It's been an hour and a half since it started - dunno if that's good or bad. I wish he would hurry up and phone

    Ah well, he was dismissed 'for mismanagement' (DH actually admitted it was a relief in a way, because he DID NOT want to go back there)

    He got into the hearing (there was only 2 of them there) and the main director had a list of stuff,some of which DH had never heard of till that point.

    The main accusation was that he intimidated the employees, and there are statements form 3 of them - but DH believes they were coached and helped to make those statements. As he says, there was a lot of banter, and they even got lifts home with him. Also, he phoned one of them last Monday and the guy he spoke to didn't even have a clue as to why DH was suspended.

    The other stuff that was brought up, I have read the notes taken by his colleague and DH had an explanation for EVERYTHING. It's actually ridiculous the lengths they have gone to to come up with half the petty stuff they brought up. Even during the break his colleague kept commenting that 'he didn't believe it' and it was all a load of rubbish. He is willing to testify against the intimidation etc as he worked at the centre as the under manager for a while.

    So, it's CAB for us tomorrow, then onto a solicitor, he wants to fight it all the way.

  • No advice I'm afraid but just wanted to say I feel for you and your OH.

    A few years ago a work colleague was picked on by our boss - refused to allow her to have a representative at meetings, slagged her off to everyone, accused her of all sorts of things basically as she just didn't like her. It was a horrible time, thankfully our boss left (with a parting shot of 'thank god I won't have to see your ugly face every morning). She was a horrible woman.

    Hang in there, fingers crossed it'll all work out in your favour in the end (it should do!). XX

    Well you were right with your thoughts on dismissal. Did OH ask for a statement of the reasons for the dismissal and did they tell him that would have the right of appeal. Was intimidation included in the last letter OH received? Were the items that were unknown to OH mentioned as being part of the reason for dismissal? OH will be relieved now that it is over so I suggest a wee drink to relax, a good sleep for you both and wake up refreshed tomorrow ready to take these *************** the whole road. Make sure that you check the costs of any advice or representation. Ask around to see if someone could recommend a good brief. If you get a real hot shot you should be able to take this bunch for all their worth without going to tribunal, with a little bit of luck. They must also prove, if it did go to tribunal, that they followed the correct procedures and that the decision was a fair and proportionate.
    Best of luck and keep us all posted on how things are going, we will not desert you now after all you have been through.

He did ask for a statement and he was also told he had 14 days to appeal Was intimidation included in the last letter OH received? The only thing in reference was 'attitude towards centre emplyees', but ddn't specify what Were the items that were unknown to OH mentioned as being part of the reason for dismissal? The two main things the director mentioned at the end as a main reason, DH was unaware of one of them.     They had clearly decided to dismiss, whatever your DH said. You probably feel better now that part is over, whatever the outcome. At least you know better now what you are up against.

    Even if what they said was all true, it would be pretty flimsy for gross misconduct. I'm assuming that's what they went for - has he been summarily dismissed (ie without notice)?

    Hope CAB and legal advice prove useful. In meantime ensure DH keeps up the job-hunting efforts as there is no way he would want to be re-instated in his job even if he wins the appeal or tribunal.

    Stick with it, you have much to gain and nothing to lose at this stage.

    You know, I don't really know. The words 'gross misconduct' weren't used (according to the notes) and just 'mismanagement' was.:confused: I'm hoping when DH recieves their letter that he requested it will state it finally.

    And obviously he can't work any notice. We have also realised that they have a 'spare' manager in the company who has come back from long term sick. He has been with the company for 6 years and was on a lower pay than DH - another reason to get rid of DH perhaps :rolleyes:

  • I feel for you totally - have just been reading through your postings. My husband in exactly the same boat - was suspended out of the blue in December and then sacked three weeks before xmas. Same situation, supposed 'failure to perform to standards expected' yet he had been doing the job for nearly ten years and this company only took over the contract last april and that was on the basis that the client insisted he continue as the manager. No probs at all for the prev nine years. They were going to sack him whatever he said - and wouldnt do anything they should such as provide evidence of what he supposedly hadnt done etc etc. They also have a 'spare manager' - the MD's brother in law - who the client wanted off his site when he got a staff member pregnant!. My hubby had also gained several contracts on behalf of them in last few months, value of prob half a milion pounds in total. Its beyond a joke really. We have submitted the tribunal app and in process of conciliation thru ACAS but that doesnt help pay the mortgage or pay for nappies for our baby!!
