.....Bit of gossip......OH got a phone call from someone he worked with at the company. He was told that the boss (the one dealing with the ET for the company) was chatting to him about it last year and said that he had told the ET that the witnesses were all on holiday even though they weren't so he could delay the ET further...his intention was to wind OH up so he would get sick of it all and drop the tribunal (his words)...
Don't suppose this person is willing to put that onto an email are they? I think that could be seen as contempt of court...0 -

Actually I think he might be willing to go as far as making a sworn statement to our solicitor, and appearing at the ET if needs be.
He no longer works for the company. They done the same to him as they did to OH, but they paid him off and made him sign a statement saying he wouldn't take legal action. (He didn't want the fight so he agreed) but being a witness for someone else wouldn't be classed as him taking legal action, would it?
Honestly, this company is rotten to the core....that was 3 managers they just got rid of last year. Another younger guy who han't been there long was told 'we need to lose 6 bodies...you're one of them' and he was out the door. :mad:Learn from yesterday, live for today, hope for tomorrow. :cheesy:0 -

I have been following your thread , i cant believe how similar our situation are . I too am supporting my husband through tribunal process .
I know just how stressful it is!
Just like your husband , mine was stitched up by the employer as well , but then that just makes me more determined!

Unfortunately the other person has decided that he is 'drawing as line under everything' and wants no more to do with the company, so has decided he would prefer not to be involved
I am trying to be understanding and tell myself it will be because he will need a reference from them when he applies for new jobs.

If the witness is key to your case, you can ask the tribunal to order that he must attend to give evidence.I am an employment solicitor. However, my views should not be taken to be legal advice. It's difficult to give correct opinion based on the information given by posters.0
