OEA - first off, I assume the EA IS a member of the OEA scheme...? Otherwise, the OEA won't pay any attention.
Also, OEA will expect you to have gone through whatever complaints procedure the EA has, and have not been satisfied with the result. Again, if you haven't done this first, they won't be interested.0 -
Yes they are a member and I've gone through complains procedure with them and not satisfied so to the OEA I must go....0

We are going to try and see if we can argue our case but if not then hopefully we can arrange to pay a percentage to the first estate agents. We just dont want to loss our buyer.0 -

Today I've recieved another letter in reponse to mine saying that the woman I'm dealing with there is on holiday as of today until 2nd March and wants to know if I could wait for a full reply until then as she wants to deal with it personally. She's also said if that isn't acceptable to contact their solicitor quoting a reference. She hopes this is acceptable and that she will revert back to me upon her return.
What do you make of that? Not sure if the solicitor bit is meant to scare me or that it's just routine now I have complained for them to file something with their solicitors?0 -

Id just like to add a mail shot of a house does not mean introducing, for a start the estate agency would have to prove postage, how many estate agents, send mail shots recorded delivery.

In latter part of career specialising in commercial - mostly business sales.0 -
as for the initla EA finding out - I only recently found out that a lot of the larger commerical ones are all tied in and owned by the same parent company. Knowing how shoddy a lot of these EA's are, I wouldnt be surprised that they contact their "sister" companies to see if they can get some money out of it too. Some expect commision payment for just sending out an email!?!?!?!?0

On a point of law I find this very interesting but does EVERY small claims court judge follow this principle 100%. If so it is the right advice for posters but I am not really sure every judge will decide the same way.
Anyone, with legal experience, who will know the answer as this point crops up now and again. Or anyone who has been advised by a solicitor on this point?
