can i calim after going bankrupt????

Just thought i'd ask, does anyone know if you can claim back the ppi after going bankrupt???? I did however have a balnce left and includied it on my bankruptcy affairs notice.

    To my knowledge yes you can.;)

    I am hoping maybe someone can correct me otherwise if I'm wrong, but if you feel you were mis sold then I would defo try to reclaim and complain.

    hiya, i havent gone bankrupt but the loan i had isnt paid off and was passed to a debt agency back in 2004. i have claimed ppi back and got a letter saying today they will refund all but it will be offset against the debt. this wasnt really what i was looking for.

    can anyone give their thoughts on this as i have had an offer on what iv paid and what i wouldve paid. i wouldve thought they wouldve gave me what id paid back to my bank account and what i hadnt paid on ppi set against the debt?

    any help or advice much appreciated

    Bumping this thread up for you so others can give their opinions here as well, but to my knowledge this is how they do this from what I have read on various posts if going through a debt agency, however I could be wrong, so hopefully someone will post up with some help for you on this, there may be ways around it, good luck.;)

    If you claim back your PPI "before" being discharged from bankruptcy then the monies would belong to the Official Receiver. It would be the same if you won the lottery or was given a large cash sum.

    After discharge then any monies refunded would be yours. However if you are on a 3 year IPA (Income Payment Agreement) and you recieve a IPQ (Income Payment questioner) you would need to inform the Official Receiver of your lower monthly payment (if any).

    But my advice is "wait" to be discharged before starting anything.

    They are allowed to do this though.

    They are merely keeping what is theirs, you write off the debt then expect them to pay you more money?

    I very much doubt you will receive anything back, you are technically in breach of contract.

    Many thanks for the replies, im now officially discharged, even tho it was granted early. I did however include a loan in the bankruptcy and this had the ppi attached too it. Dont want to cause more problems by continuing. Just wondered if anyone else had successflly already done this.

    If the loan was included in the bankruptcy then any
    ppi would belong to the OR.
  • Hiya, i was in the same situation with Halifax over 1 wk ago. they agreed to settle the ppi as if id never took it out. I was given a redress figure of 1104.99 and remaining ppi of about 1700.00. They sent a letter saying as my loan was in arrears(sent to debt agency in 2006) they would be off setting it all to the arrears. I wrote back and said no way!! they could put the remaining ppi to the loan arrears but the amount i had already paid(made up of actual pymts and interest refunded) i wasnted paid back to my bank account. I got a letter in yest advising that i would recieve a cheque within 14 days for the full redress of 1104.99!! and a reminder that my loan acc was still in arrears.
    to be honest I wrote back to them chancing my arm on any money being paid to me and am very surprised they did. I did quote in my letter that the FSA would award the money to me so i dont know if that helped or if hbos just did it for a quiet life!!
    Chance it and see how you get on. I can now use the money to clear off a cc that charges interest every month!!
