Advice about AIB in Scotland

    I applied for bankruptcy under the LILA route on the 5th of Sept, got Form 17 through less than week later, filled it in and sent it back and was awarded bankruptcy on 22nd, September 2008. That was the extent really of my dealings with the AIB so far.....no further contact, no calls, nothing, nada. I was told to to expect a paper review of my circumstances in March and then to be discharged from bankruptcy on 22nd September, 2009. I can honestly say pre bankruptcy was a far more stressful time than post bankruptcy and I've heard nothing from my creditors since I sent notification of my bankruptcy to them in September.

  • Thanks for the information Eternal Optimist I hope that happens to me. I think I have so many scary thoughts about what might happen and to know how it was for you is really positive. I am happier now I know that I will be going br, but there are the bad days when I am so scared of what is happening.

    I will hopefully get the forms finished this week and hope to have enough money to put in for br next month.

    I petitioned for my own BR (not under LILA) in Scotland last May and was also made BR in June - at that time things were taking longer than usual due to the law change on 1st April that I think many people had been waiting for.

    After I got my BR certificate from AIB, they passed me to an independent trustee who wrote to me and requested I contact them to discuss things. This took the form of a brief (15 minute max) meeting at their office where an admin person filled in a form and asked me some questions (which were repeats of what was on the original AIB form). I was really worried about this interview but it was a breeze, no judgement, just simple questions, mainly yes/no answers and i didn't have to explain/justify anything.

    After that I was sent a copy of a letter that was sent to my creditors which stated my assets and liabilities.

    I heard nothing more until my 6 month anniversary, where I had to fill in a income/expenditure form and send it back to them with a couple of payslips.

    I've heard nothing since.

    My case was fairly simple, a lot of unsecured debt and living in rented accomodation, so no house to deal with.

    I must agree with the previous poster that I was at my wits end with letters/phone called and people at the door before going BR, but the instant I became BR the weight off my shoulders was incredible. I answered every call from the day I got the certificate and told whoever it was I was BR and they were, without exception, fine, even scum like wescot etc. The calls stopped within days. Similarly, any letter I got was faxed back to the creditor with a copy of the BR certificate and a letter telling them to speak to the trustee.

    The process has been smooth and much more stress free than I imagined it would be, which I really thank the AIB for, things are bad enough for people who go BR without added stress.

    I also think that the whole process had really taught me some lessons - no more credit cards (apart from my prepaid Virgin one) EVER - keeping proper financial records - and most importantly, NEVER to hide from anything again. By finally realising I had to do something about the situation, I feel that I have turned my life around and I only have positive thoughts for the future.

    I'd also like to say that in the months whilst I was waiting for the "Charge for Payment of Money" that I needed to declare myself BR, I read every thread on this site, every day (and still do), and the information that I got from here was invaluable. Whilst much of the legislation relates to England and Wales, a lot of it is relavant to Scotland. Having a lot of information made the process a lot easier, especially when it came to income/expenditre at the interview, as clearly whilst you need to be honest, it is also important to remember everything so you have a chance to get yourself through the year of BR relatively sane.

    here s my story so far
    after years of struggling to pay credit cards etc robing peter to pay paul i stopped paying my debts last january 2010 after missing one payment and after recieving a phone call DEMANDING THE PAYMENT threats etc i decided to do something about it so contacted national debt line and they advised br wanted a second opinion so contacted money advice scotland again advised br both said that as i didnt qualify for lila i would have to wait for a charge for payment , so the phone calls started about 8 to 10 a day phoned my work but office staff were very helpfull said i couldnt recieve private calls so they more or less stopped then i changed my phone number no problem told bt i was recieving nusiaance calls .the letters came threatning this and that filed every one AND THANKS TO HERE AND THE WONDERFULL PEOPLE ON HERE i didnt panic as you would if you didnt know what to do.
    charge for payment came exactly 1 year later mind you it was from council NOT debt collectors. so i went to moneyadvice and they filled in forms for me when i looked at them they wernt really hard to fill in only hard bit was dates for debt and i found exact date with EXPERIAN 30 days free then you can cancell before 30 days are up
    i took forms to AIB payed £100 and they checked forms to see if ok and informed me that i should get word by end of week
    thats me so far

    broxie ps ( forgot to say you dont need to wait for charge for payment now you can get a letter of sequestrian from cab or any money advice councilor now )
