UPS delivered parcel to neighbour + stolen

  • So the delivery guy turns up at the house next door, to collect a delivery that was supposed to have made to you; without notice; and your neighbour happens to be in; and hands it over with no paperwork, receipt or anything?

    That doesn't stack up to me.

  • I can't claim from UPS. Microsoft is their customer so it has to be them. I am going to contact citizens advice tomorrow and call the local police. At least I may give them a bit of stress by being investigated. I doubt the police will do much tho.

    It seems likely to me that you can claim from UPS - you don't need to have a contract with them. They very likely have a legal relationship called "bailment" with you. And/or they owed you a duty of care and have been negligent. It's hardly worth instructing a solicitor for this much money, but you could look it up on the internet and write to them. Then there is the small claims court. Good luck,

    I sent my xbox off in the box i bought it in as it was obviously a good fut, it came back in an annoymous white box I think with just a label for my name and the ups sticker

    Same here when I sent my sons off a few weeks ago..

    UPS delivered it back to my neighbour, who had to sign for it. The card left for me also had my neighbours name on it.

    The packaging was a white box, with all my sons details on it (name, address etc).

    Your neighbour must have opened it ~ he might have thought you had moved out when he'd tried to knock at yours and got no answer.

    Maybe you should just straight out ask him if he has it, just tell him you're not bothered if he's opened it, you just want it back.

    Failing that, would the Police be able to help, ie search his property for the console?

  • I have reported it to the police today. They are sending someone round on Sunday.

    When I spoke to the neighbour at around 10pm last night I was considering saying "look, just give it back and it will go no further". The problem is once I accuse them it may get confrontational.

    I made of point of my concern as to why a random person would turn up to collect it. I also said the company that sent the package were contacting the police (so it didn’t look like I was turning the heat on) hoping they may reconsider and juct "find it". This may not have been a good idea tho as now they may think about the story a bit more and get rid of it if they still have.

    I checked the bins and there is no sign of the packaging.

    just contact microsoft. it was supposed to be delivered to you, and that is what you paid for. they failed to do that (or rather UPS did, but to be honest, that's nothing to do with you, it's their problem)

    they are liable to reimburse you.

    I would not even bother getting involved with the neighbour. Microsoft sent it to you so until it is delivered to you it is their responsibility. Let MS and UPS fight it out between themselves.

    It is down to UPS to involve the Police, not you, in fact I am surprised they have got involved at all.

    Just tell MS item not received and ask them when they will deliver the item to you. Simple as that.
  • Prepare yourselves for this update. It’s a sobering one.

    Having phoned the police who were going to come round on Sunday I was worried the couple may try and change their story when confronted by them. I was worried they may try and tell the police they had actually given it to me.

    Please try and remember how ridiculous their story sounded. I will also explain that where I live is in a flat in block that consists of 12 flats on 3 floors. There is a coded door at the entrance.

    I went to have one last chat with but decided to record the conversation using my mobile phone camera wanting to get the same story in case they changed it later and ask a few more questions. I went round with my girlfriend, started recording and knocked.

    The chap answered and I started to question him, asking him about the guy that took it and when he came, what did he say, did he pretend to be me, any id etc. He continued with the same story. When quizzed more about the guy he got his partner who came to tell me more about him. Apparently the guy rang the intercom to ask if a parcel had been received. When she said yes and went to the door he was already in the main block so knew the outside door code. He asked if she had a parcel for “number 50”. She gave him the parcel and off he went. She never mentioned the number 50 last time I spoke to her or if she did I missed it.

    I live at 60!

    I went round to number 50 and straight away he produced my xbox. It seems he had one on order and wondering if it had been delivered (im not sure if he had been told it had been) rang every buzzer to see if someone had taken it in. After getting it he noticed it wasn’t his but kept it and knocked on mine a few times. Of course I was away and when I got back had a card saying 40 had it.

    By this time 40 were a bit vague as what had happened making me thin k they were having me on.

    I’m still in shock that it has actually turned up and feel pretty bad about assuming the worse. I was certainly in the 95%+ area for assuming they had nicked it. I am now so glad I didn’t asked them to “just give it back”.

    I have called the police to cancel btw and will calling Microsoft next.

    Very strange set of circumstances indeed.

    Did they repair your xbox or give you a refurbed one, I got a refurbed one and 1 months live membership

    I still can't believe how this has played out. What gets me is why didn't she mention they guy said number 50 earlier? Also why when the guy realised it wasn't his why did he keep hold of it? I would have had the sense to return it to who I took it from.

    My console has the same serial as the one I sent and has a letter saying it has had a new motherboard. I also got the 1 month live card.
