Withholding of prrof of no claims

Hi hope someone can help me please. Just cancelled my car insurnace and asked them to send me my proof of no claims. However, they are saying that until I pay cancellation fee and this months DD they are going to hang on to it. Can they do this?
I have sold the car so I'm going to be paying insurance on a car that I no longer own.

No they cannot do this, it used to be common practice if you owed money but a ruling was brought in afew years ago stopping this happening.
Ring them up and advise them of this.
If its the broker doing this just ring the Insurance Company up directly and ask them to send it out to you.
P.S You will probably have to pay the cancellation fee at some stage, there is a good thread on this forum that covers this0 -
Thank you for your reply. I have said to insurance company (churchills) that I don't think they can do this but they say they can and will. I need the proof but they won't send it until I have paid fee and this months installment...

I cannot get into the relevant part of the ABI site that covers but apparantly it says the following. It should state in your policy if they can with hold your no claims bonus
"Written evidence, such as proof of no claims discount, must not be withheld from the client by way of a lien unless the client is advised of this in writing and given adequate and justifiable reasons for the action taken."
The other things to do would be to ring the Financial Ombudsman and ask for their advice.
Or some Insurers will ring up your old company armed with your policy number and ask the m to confirm it over the phone (They often will in these cases).
Like I said before you will probably have to pay the cancellation fee at some point so it might be worth just paying it now so you can get your ncd0 -
Thanks again for your help. I will pay what I owe but they are adding this and that and in total they will want just forty pounds less than it is costing me to insure my new car for the year!
Thats a different matter anyway. Just annoyed that they can threaten me with this. My no claims has been built up over thrity odd years not just the two that I have been with Churchill. Thank you again.

Like I said if you want your proof of ncd ring the Financial Services Authority on 0845 606 1234 as they and their rules tend to side with the customer and Churchills have to abide by what they say.

Hi there, sorry been to work and just got back in. I sold my car an 04 punto and sold it to my student daughter and got myself an mx5 merlot. Because my insurance on the punto was 250 a year approx I thought that it would be loads with Churchill so used gocompare and got insurance for £125 for the year. After all I've been with Churchill for a couple of years and each year the premium was higher.0

Does that make sense?
£125 for the year for the mx5 with Saga (I'm getting on now you know)
£250 for the year for the Punto with Churchill.
So I switched but Churchill want cancellation fee plus this months DD plus something else and it totals £83. I'll sort that out I think but it was the Proof of no claims that was bothering me. Going to ring again in the morning and see what they say.
