Appealing Against Tax Credit Decision

Hi There

I am in the process of appleaing against a tax credit decision for this year we have recently found out we could receive disability tax credits for our daughter who is autistic and they back dated us 93 days and that is it so we have appealed for the rest of the money to be back dated to the begining of the tax year as we started claiming DLA for our little girl in November 2007.

Does anyone have any experience with appeals with the tax office and do you know how long they take and what will i expect.

Any advice would be wonderful

  • Did you inform then in november 2007 that you were getting dla for her?If not then it looks like they have backdated the payment 3 months which for many benefits is the best you can expect
  • I agree with Woodbine, the best you will get is the 93 days backdating.

    The guidance states that you need to notify TCO within 3 months (93 days) of the decision being made.
  • unfortunately we did not notify them because we did not know we had to that why we are appealing against the decision.

    to be fair, I can understand its frustrating, but tax credits always harp on about informing them of a change of circumstances. Surely your daughter getting DLA would be a change of circumstances.
    They backdated 93 days so that was probably a nice lump sum/suprise for you. I would write off the rest of the money, as you didnt inform them then you obviously were not expecting it.

    Maybe next time something changes just call them, you might get another increase.
  • i would still like an explanation when we got it in writing that they woulc back date to the beginning of the tax year and then decided to pull the decision

    It is generally standard policy that they only go back 3 months, and I agree there is publicity advising to inform of any change in circumstance.
    Yes it might be frustrating but look what extra you will get from now on, plus the 3 months extra.

  • yeah but because we were not informed to declare the dla we have lost out on about £2,000 worth of benefits we could have taken our autistic little girl on holiday

    Not informed by who ?
    As already said tax credits advise you to inform of any change in circumstance.
    Maybe now you have more money you can save up to take your daughter somewhere nice in a year or two ?
