It all sounds a bit odd. Was the driver of the Clio in some how connected to the system? If it was just a random member of the public then it'd be their word against the OP's husband.
Years ago I overtook someone on an A road. A few miles later they caught up with me (by speeding through 30 limits). They then reported me to the police for "dangerous driving". The policeman said it was my word versus theirs so there was nothing that could be done really.Happy chappy0 -
dangerous driving is simply classed as driving below the standard of an average competant person and it only takes one witness .

the purpose of the intended prosecution notice is because the police have 14 days from the report of any motoring incident otherwise it would get struck out from court unless under extreme conditions .the police then have 12 months to prosecute after which time if your husband is not informed then the case will be struck out .

Just an update, was interviewed and explained what happened. Had letter today. Now going to magistrates court 24th Aug. Got to complete form with income and outgoings and take driving licence in case of points or loss of licence. He has contacted a solicitor today who specialises in motoring claims. Cannot believe on the say so of one person he can lose his licence and our livelyhood. What happens if he goes and comes out of it ok, it will have cost a fortune? Solicitors are expensive but he has clean Hgv and driving licence.
What did your OH say in interview?
If he wins he gets his costs paid.
If he is convicted of dangerous driving, he will be fined and disqualified from driving for 12 months minimum. Hi he just told his version. He is seeing a solictor tomorrow. He has a clean licence and HGV is his livelihood so hoping even if they do go in other persons favour that he only gets fine/or points or both.0

Your OH made a mistake by agreeing to an "interview"... he should have politely declined the offer. AFAIA unless arrested he has no obligation to attend.
The police use these interviews to fill in the holes in their case & you have to be pretty good to avoid dropping yourself in it, whatever you say can (& will) be twisted to suit.sarahg1969 wrote: »At this stage, do not make any contact with the police. There is clearly far more to this than posted.
The police/system would not prosecute someone for dangerous driving on the word of another motorist. Especially not if that persons own conduct was in question.
Either there are witnesses or the person is well connected - unlikely.
It seems far more likely this is just yet another HGV driver who bullies there way about the roads and puts people at risk to deliver their loads 30 seconds earlier.
Also if the other driver was speeding, being dangerous and on a phone would they really even risk reporting it. sounds like excuse making0 -
Its it possible the stretch of road was covered by CCTV and that those operating it reported him? I know that can happen. They pass the evidence to the police and they trace the driver.
If your husband was in a HGV then the fact the other driver had his high beam on shouldnt have affected him so much to retalitate as he is in a totally different postition to another car lower down. If you husband wanted to let him know he had his high beam on he should have just flashed him once or just let him be and move lanes. Anyway none of that matters now.
Has you husband asked what evidence there will be? you will probaly know more once you know this.0
