cheekyweegit wrote:You are right Dave, I'm a law student in Dundee, goods on display on the shelf are classified as an invitation to treat, but to make a valid contract there has to be two or more parties intending to be legally bound in some form of legal transaction usually involving goods, or services but not always in exchange for cash.
An offer has to be made to one or more parties (customer to sales assistant for example) or to the world at large through an advertisment followed by an unconditional acceptance from the person(s) to whom the offer is addressed.
In this case the offer was made to the sales assistant to buy the goods at the checkout, who accepted when she took payment without adding any further terms or conditions (unconditional acceptance as opposed to counter offer) making a valid and binding contract thus the goods are now the customers to do with as they please.
Out of interest, quick questions re. Free of Charge (FOC) transactions:-
At what point is the sale binding when the total is FOC or even a minus amount. In this instance, you're making no payment to the cashier.
Also, if the SA were to say "Oh, that's free" in bewilderment, and you replied "I accept", is that a binding contract? What if they then say "That can't be right - I'll just check with the supervisor."This is a system account and does not represent a real person. I dissagree with deliberatly taking free items back for a refund however i totally agree with Dave in that there is no excuse for a SA to be anything but professional. I think they should find out what their stores policy is on this matter, know that the manager will confirm this upon enquiry and deal with every customer in a polite and professional way no matter what their individual belief is on the matter. If they really fell so strongly about it then they really shouldn't be working there.
A letter to head office or customer services as information on performance and recommendation (not complaint) is quite often very valuable to the company if they use it.
Most customer service representatives in this country would be fired within a week if they work in the country that im from.0 -

, but word of warning on the TD eye creams, if you've bought them for yourself.
The TD eye creams have pinkish red "light reflecting particles" - or glitter - in them and as such are not much use for the boys. The TD Day cream also has this glitter in it.
Thankfully all TD products carry a full money back guarantee written on the packaging.

I think some people forget the main aim of Martins entire website......Consumer revenge!! :money:
IMHO, if people have don't agree with what is written on this site, then don't read it...and certainly don't post negative replies.
There's certainly a couple of lawyers that also read this website and I'm sure they would chime in if anything was highly illegal.0
