Bizarre, the only case I can think of is the Reading woman who spent £47,000 (Bank error) which the judge laughed at and threw out of the criminal court, it was at the civil court stage that the defendant agreed to repay the sum with interest, there must be more to the tale above of someone being sent down for 18 months for such a small amount of money, do you have any case references, I'd love to read it as part of my studies.All I can say is from my experience, under normal circ's the matter is resolved between customer and bank and the money paid back that being an end to it.
However I did as a Police Officer deal with a similar incident and it went to court and the customer did go down for 18 months, and it was a lot less than £5k.(he spent it)0 -

Personally I wouldn't want the worry hanging over my head, so I would give it back.
No legal reason, no moral reason, I just don't want to have to worry about what might happen and the hassle of being careful to keep the money unspent.
Too much hassle - for what? a few months of interest?0 -

Yes no one is going to face legal proceedings for not notifying the bank but the problem arises when the money is for whatever reason not paid back and the only reason I can see for not notifying the bank is because it's going to be kept.
