She does need to check her own insurance policy as she can be insured to drive any other car (3rd party) and whilst she is driving the car its insured to be on the roads. Its when she gets out of the car its no longer insured.

The car doesnt have to be insured to be driven as long as the driver is insured.

My insurance policy covers me to drive any other car, 3rd party, as long as the car IS actually insured by someone. (I rang up this weekend to check if I could drive another car).

So I'm not sure that she would be covered by her own insurance in that case, since the car is no longer insured.

My policy also says about the car being driven "with the owner's consent" :o

Edit: This is actually an interesting point since our only car is in my name with OH as named driver... I wonder what would happen and whether he'd have any issues taking over the insurance and using the car if anything happened to me
working on clearing the clutterDo I want the stuff or the space?
  • When my father died my mother continued to drive their car while she was making arrangements (registering his death, seeing undertaker) as she assumed she was covered since she was a named driver on the policy. Only found out when she contacted the broker that she wasn't.

I was named on my mothers car insurance. I was visiting her in hospital. She died soon after I had arrived. I drove home very carefully as I knew that I was driving an uninsured car and phoned the broker first thing next morning and was given temporary cover. The question of who owned the car never arose.

Perhaps the issue is that an insurance contract can't exist between an insurance company and a dead person ?
.................:)....I'm smiling because I have no idea what's going on ...:)

Although the link doesn't cover this specific question, there is some useful info here: http://www.direct.gov.uk/en/Motoring/DriverLicensing/DG_4022493

I think Errata is correct - the contract will no longer exist if the policy holder has died.

Perhaps SAGA would allow temporary cover until DVLA confirm ownership is transferred.....they would of course have the OP's word that the documents had been posted to the DVLA, and that the vehicle was in their name, just as anybody buying a car in normal circumstances would do.

I'm quite sure she can't because the car no longer has an owner as such, so nobody ought to be driving it til the ownership documents are changed?

That's what we've been told! Sister is currently changing registration to her name... but til then LIMBO LAND!
  • I'm sorry for your loss.

Just curious, if she had insurance, and had to do some running around etc.
why couldnt she just have used her own car and avoided all this bad feeling

Her's is knackered and awaiting repair. They're not awash with money, so, using Mum's car seemed like the most obvious solution!
  • I had a very similar problem when my husband died 2 years ago. He was one in of the family cars at the time of his death- registered in my name and he was a named driver on the insurance.

I drove about (in a daze) for the next 2 weeks in the other car which was registered in his name with me as the named driver, unaware of the fact that I wasn't insured as technically the car had no owner!!!

Thanksfully nothing happened in the time, and I only found out when I rang to transfer the insurance!

And so it is, but the right way to do it is to transfer the car to her as registered keeper, and to transfer her insurance to her Mum's former car. Then sell the knackered car once it's repaired, or sell the Mum's former car and transfer the insurance back onto the knackered car.

I think the "it doesn't have an owner" bit is rubbish. It belongs to whoever inherits it from her Mum. But if that's her, then she certainly can't drive it using her "driving other cars" extension.
