OSPS should I send it back?

Hello all, received my new handset from the OSPS today. Good deal, Moto V3i your talk 200 £30 pm but 7 months @1.99, so all in all about £13.66 a month.
Tried to activate it via Orange, and they wanted £50 Dep (!!!!!!!!). Contacted OSPS and told them this, their reply was basically if you dont like it then send the phone back!! Yeah, Ok I thought, 1st line monkey attitude. She harked on about the T&C's (its not in there) so I looked at Orange's T&C's. Low and behold there it was section 11 - Deposits.
My argument to them was that I took out this legal contract with OSPS - not Orange. If Orange want to charge £50 Dep then get it from them. They advertise with Free connection (but only when Orange give it back to you 12 months later). The OSPS did say it was a down to the credit check that hadn't been registered by the system but by pure virtue of me having the phone, the credit check was OK. But Orange cannot access that info because of the D P Act!!!
Have I been duped by some misleading info, unlucky? or should I say sod it, send it back and try and get e2save to match the deal??
I know the OSPS have had their probs with staff attitude but today presented itself with a mixed bag of helpfulness. So it could be down to who answers the phone really with them

AS OSPS and e2save are the same company, not sure sending it back and applying again will achieve much (and will add another search on your credit file, which you may not want as could potentially have a negative effect on your credit rating if too many in a short space of time). Isn't there anyone reasonable at Orange who can explain why they need £50 deposit and how long they need it for?
I believe that the DP Act issue is flannel - you have given OSPS permission to pass your information on to Orange (and no doubt this works the other way) so that the contract can be set up - if it was negative, Orange wouldn't have agreed to letting you have a contract ... therefore OSPS wouldn't have agreed to you signing up and wouldn't have sent you the phone. It may be worth going back to OSPS and politely asking them to pass on the information to Orange again (particularly the credit reference info) or you will be returning the phone (then they get no commission and it also counts against them as well which may prompt action).

Thanks for the replies. well, I sent it back. If I thought yesterday was bad with them then today has just taken the biscuit, the pack in fact.
Decided to give Orange a call to activate the phone, cheque card in hand. Indian woman (oh ho), not racist, as I'm indian too!! Told her the full story (again) phone barred etc. She tells me that the CPW had put a barr on the phone, not them? OK, well take my money and un barr it I thought. After keeping me on hold for a further 10 she tell me that they can't lift the barr, only OSPS. So that's different to what they were telling me yesterday. So, phones OSPS up again, and they can't understand the situation, they put me on hold, speak to Orange then come back with the 'sorry the DP act prevents them from disclosing info' yardy yar. So I said who can lift the bar? Well we can take the payment was the reply - yeah right you can. Even though it states free connection. Are you willing to pay? Err, no not willing but able as it's contrary to your T&C's. Well you'll just have to hand the phone back then. So that's it, I am totally dumbfounded by two companies who could not decide on who lifts the bar on the phone. And why there was one in the first place. What a farce. To add salt to the phone bill wound, it's cost me a further £5.35 spec del to return. Asking if they would return the fee (stupid question of me, I know) they said well send in a copy of the spec rec ticket, a letter etc. I told them that this was the way they handle all their chequeback queries and was told that it has all changed now??
All in all about £10 and a credit check out of pocket from OSPS....keep away.
I'm out of the country for a while now, as long as they've signed for it can I be assured that it will be the end of it or should I contact the back etc?

Ummm I've had this situation after buying 2x phones on Orange via the CPW about 6 months ago. At least ten calls between Orange and CPW to try to get the things connected and a £100 deposit required.
To cut a long story short(ish) if you have this problem go to an Orange store explain and pay in store using your credit card (added protection and receipt in you hand when you leave). My local CPW and Orange outlets are opposite each other on my high street and it took me 4 trips back and forth to achieve this, I got nowhere on the phone. Orange stated that this is standard practive if you have more than one contract with them.
I've just purchased via OSPS and have my doubts about them; customer service seems variable and they never stray from the 'return the phone mantra'. In my case they cocked-up the contract and the handset, but like you I'll still have to pay Special Delivery charges and then 'write a letter' if I want to get the cost back - this is clearly a way of limited their admin expenses as they asume people can't be arsed - they will get a letter and a bill for my time writing it. If something is a company's mistake I shouldn't make up the cost of rectifying that error.
There's also an address for Charles Dunstone CEO of CPW which OSPS are part of on another thread - why not CC him in on any complaint you make.
OSPS are fast developing a very bad rep for customer service, which CPW will probably be keen to avoid.I do hope you're telling the truth?0 -

If you ordered over the phone (or maybe on the internet) you can tell them to pick up thephone and cancel the contract. Informing both companies involved that as you were not informed of the requirement of a £50 deposit that you are entitled to cancel the contract at no expense to yourself.
If they complain tell them they should of told you about the deposit requirement before trying to sell you the phone.
