Well I was under the impression that people could post on forums like these to get help and give advice. So I must have misunderstood somewhere along the line that apart from a few ppl who have given me a humble reply and response a few have mocked my situation.
Fair enough everyone is entitled to their opinion but I would rather not leave any comment than leave a sarcastic one. The point of making a thread is so people can get help & advice and also others can gain knowledge through other peoples stories, and I cannot see the logic in making blunt remarks and up the nose replies.
So you explain to me what benefit will people get when they read these snotty remarks?0 -
Guys, please give the OP a break!! I thought this was a public forum, he has query of certain issue, you either know the answer or you do not. It is his responsibility what to do with this new knowledge. Why do we need to judge?? It is his choice to use a loophole or not, if it is legal!! I would not do it but that is my choice.

The CCA has helped me as I can confirm that it is not enforceable. I have every intention of paying, I am not in any default. I only asked for a CCA in case I get any future problems,

sophiak there are some judgemental members of this forum.
However, I think your posts have lead to some confusion.
You mention being charged £12 for late payments, sometimes correctly, sometimes incorrectly. You also mention no response with regard to your PPI removal requests. You have a right to follow the official complaints procedure on these issues which could well lead to refunds and/or compensation. This is the route to take if you are intending to continue making payments on this debt.
The route of requesting the CCA is aimed to make the debt unenforceable. Indeed if no CCA is forthcoming, then the debt is legally unenforceable. If this is the case, then you are not obliged to make any more repayments and the creditor cannot post negative feedback on your Credit File with regard to unenforceable debts. This is not necessarily a recommended process and you will run into obstructions from the creditor so you should be prepared for a confrontation. It is your decision whether you go down this route, not that of other posters on here who have their own moral viewpoints.
My point is that you need to decide what exactly you want to achieve in your negotations with your creditor and then determine the appropriate action.

Thank you Nickx for your sensible reply. I apologies not being clear in the beginning, I have decided what to do. I have written asking them to refund all my ppi payments and refund the £12's charges and I will pay £50 a month until I clear the debt. I will wait to see what response they give me,

My OH has an arrangement to pay off his credit card debt with HSBC at 5.00 a month and he has checked his credit file and they have entered a default against his name. Are HSBC allowed to do this?
He received his cca agreement after sending a cca request and it was enforceable because it had his signature. He has not received his S.A.R since requesting it in Dec 08. The Information Commissioners Office have written to HSBC asking them to comply with his request.
HSBC raised other half's credit limit also without him knowing to £3,100.00. Are they allowed to put a default on his credit file even if they don't comply with his S.A.R?
He really wanted to get hold of this because he knows that there are a lot of charges and interest that have been applied.
Any suggestions from anyone on what to do next please?0 -
Yes they are allowed to do this as he has defaulted on the agreement. Hence the "default" mark on his credit report0
