Well, I got a reply again today saying that they are still investigating my case and may take another 4 weeks. Talk about stalling!!!
Hi hun
Hope you hear soon with a good result.
They have 8 weeks to respond in full, if they do not meet that timescale they are entitled to, you can go straight to the Financial ombudsman service (FOS) if you wanted to.
Good luck.;)The one and only "Dizzy Di"0 -
Yeah I am tempted to write back and say that is fine, but after the 4 weeks if I have not heard with a favourable response I will be asking the FO to investigate.0

Well I got a reply and it wasn't the news I had hoped for! They sent a copy of the credit agreement and I did tick the box for PPI! They said that the policy was administered on a "no-advice" basis so no recommendation was made that it was suitable for me. But they do say that staff provide you with full information in it which they bloody well did not!
Also I turned 18 on 6th April 2001 and when I called to ask when I opened it I was told on the 9th April. BUT on my application I have signed and dated 4th April so this was BEFORE my 18th birthday! Therefore, is this not illegal???!!!
I also appear to have ticked the box that I was working full time which I was not!
Can you help me any more please?0 -

Hi there am sure di will be back on soon. In the meantime if you are absolutely positive that you would not have just ticked it so you could get the card then write to them and tell them that you did not tick the boxes and the Onus is then on them to prove it.
Was the box pre ticked or was it written in by hand may I ask.:mad:0 -
Can I ask what you mean by pre-ticked or written in by hand?
The PPI box was just ticked but to be honest it kind of looks different to the other ticks and it is also a photocopy they sent me!
It is the fact that I signed the application before my 18th birthday and that they accepted it that I find astonishing!!!0 -

Hiya hun
Sorry to hear this but write back to them and tell them even if it was ticked either by yourself or self ticked, it was worthless to you anyway, tell them if it was advised then obviously you would not have taken it out, as you would have then realised it would be no benefit to you.
This is a standard response hun, so keep on at them until you receive the final response, if they do not resolve this in your favour you can move this on to the FOS, they should let you know this in the final letter.
Keep at them and try not to worry, its all standard.;)
Good luck and keep us posted, so we can help more if required.

What about the fact that I signed it before I was 18?
I will certainly be replying to them! They have given me the address in the letter for the FO and said the next step is to contact them. Do I do that or write back to them first?0 -

Hiya hun
Sometimes these agreements have already been crossed, some of my agreements are the same, so they added this whether you chose to have this or not.
What I mean is you did not cross them and you will note their own printed cross right by the PPI, is yours like that do you know?
Despite if it has been or not, why would you pay for something that was worthless to you anyway, and back then many thought it was all part of the finance/agreement.
So keep fighting, like I said in my above post.;)The one and only "Dizzy Di"0 -

Being the age you were, I feel that was wrong, and being vulnerable at that age anyway, you do have a point.
Arh right they have already told you to take this to the FOS then?
Okay hun, well what you do now then is either ring or download a complaints form from the fOS website here:
http://www.financial-ombudsman.org.uk/accessibility/easyread.htm
Enclose a copy of the letter from the finance company to go to the FOS, you can also if you want to get a copy or 2 done, send to the Finance company as well, also keep one for yourself.
When you send a copy to the finance company, make them aware you have enclosed a copy of the complaints form for their interest, sometimes this can change their minds, if they do then let the FOS know.
Ask for help anytime hun. Good luck.;)
