Buyer trying it on. What to do?

I'd appreciate any advice you guys could offer,

After a clear out at home I listed 2 nintendo SP advance gameboys and a load of games in bundle lot on ebay, although both consoles were used they were in my opinion in good condition I did not have any scratches or marks that I could see.

I thought they would be bought by a family with a couple of kids, but have been bought by someone who trades in gameboys and games (i can see that from their feedback and items for sale)

The buyer has contacted me saying that they are disappointed as the consoles are scratched and marked, but they have not made any specific request at this stage -

-however I can see that they have already split the lot and listed at least one of the games back on ebay as a buy it now (it was an unusal game so I can be pretty sure from the listing it is the one from my lot, there are other games in their listing that i think are mine) - is that not a bit cheeky when disputing the sale? :rolleyes:

What is the best approach: should I query the items they are selling? or suggest they send the whole lot back for a refund? What do i do if they send back something that was not what I sold?

Should I just cut my losses and offer a partial "goodwill" refund/reduction that they will no doubt haggle over?

I'm not a pro ebay seller, I just list stuff that I no longer use that might be useful to others, I feel that listing the items as "used" but in good condition was a truthful discription

Anyone else been in this situation?

    Personally, I'd wait and see if they open up a dispute, but if they do then you will pretty much have to refund them...but the good news is that they would have to send the items back to you before you refund...the bad news is that they could send a brick to you, but as long as they ave a tracking number then PayPal will find in their favour :(

  • Check your pictures see if there are any marks, if there are none then stick to your guns - tell him you are sorry he is dissapointed but you have check the several pictures you took and beleive them to be as described.

    It annoys me so much buyers going for partial refunds is increasing big time. Personally i wouldn't offer this, espically if you think he's trying it on.

    I would insist he return for a full refund but you also need to be careful if this guy is a dealer he might try to send you different consoles back.

    The pictures are of the screen and the inside of the consoles, the buyer is saying the marks are on the outside (which I'm sure there was nothing noticable to my 20:20 vision).

    They haven't asked for a partial refund or any solution yet, but as they are already reselling part of the listing it is obvious the are not intending to send the whole lot back.

    If I say that I have a log of the serial numbers or that the consoles and games were police marked with smart water - do you think that might deter them trying to send back some of their damaged stock?

    All their feedback looks pretty good, how would I know if they'd done this before?

    I guessed something was up as the item tracked as delivered on 04th Feb and they had left good feedback for other items after that date, but no feedback on mine, then I got an email from them yesterday saying

    "Hi. I have received the gameboys. I must say that I was disappointed that I paid so much for them as you said both had no marks on them and that was far from the truth. Both of the consoles were marked on the outsides"

    Personally I wouldn't do anything at this stage.

    If hes broke up your items and is currently reselling some of them that does kind of give you an advantage over him.

    If he sells part of what you sent him and then opens a dispute then just say send it 'all' back for a refund. ;)

    I would politely reply saying that you are also surprised that there are marks on the consoles, as there certainly weren't any when you sent them in the post. Ask him if he can send you some photos of these scratches, so you can compare them to the detailed photos you took before sending, along with the serial number etc...

    (Did you take good photos showing no marks??)

    Say that if he is unhappy with them, he can return the entire package via trackable means for a refund. Hopefully he won't send you a brick!

    Read his feedback to see if there are any indications of partial refunds.

    Is this brick thing common? I'm quite worried now as I'm probably going to have to get a buyer to return a phone to me because of their inability to read my description. Paypal much be aware of this scam?


    Just a thought.... What if you refused to sign for a returned it? What happens then?

    I believe a tin of sardines is a popular substitute for a phone. A brick would cost quite a bit to send SD. I'm sure paypal know all the tricks but how can you prove what was in the package? If you refuse to sign this will show on tracking as refused so paypal will probably side with the buyer so you will be minus your dosh and your sardines!
