Comet REFUND?

Hi, I hope that some one can help with my problem.
On the 21/12/2008 I purchased an mp3 player for my partner as a christmas present. The problem is so did her mother. I decided to go to comet and get a refund on 28/12/2008. No problem I thought. The girl was very helpful and proceeded with the refund until she clicked the "wrong button" and issued a "Head office refund". This meant I'd have to wait 28days for a cheque to be sent through the post from Head office. Being the patient man I am I just went with it.
30 days later, still no cheque! I rang customer services who have told me that no information was received from the Dunstable store in regards to the refund and they rang the dunstable store whilst I was on hold.
They confirmed that the refund has shown up on their store computer. I was put through to the store to find out what the problem was. I have now been told that the store can do nothing as their computers show I have received a "head office refund". They say thay are sending a fax to head office to show head office the refund information and that it could take another 2 weeks to get a cheque.
I asked if they could cancel the Head office refund on several occasions and put the money back on my card but they insist there is nothing they can do and I'll have to ring customer services once the fax has been received. I need my money back as I have no product and no refund, is this legal? The date is now 8/2/2009 is that not plenty of time to get a refund?
Any advice would be gratefully received as I'm at my wits end with these people passing me from pillar to post!

Refunds are normally done to the card immediately and a reciept given.
Seems there is more to this one somewhere, as to me, if I had not got the refund there and then, I would keep the product. Seems as you do not have the product, not a refund reciept, there is little you can do, apart from wait.0 -
Maybe the girl at checkout scammed you!
Never have heard of a head office refund, but just wait a bit0 -
I have already waited over a month, I do have a head office refund receipt but I feel that they are just stringing me along and earning interest on my money. They have even taken 10% off the refund as a restocking fee!! The packaging was as new.
I've been told that if the staff issue a "head office refund" there is no way they can cancel it and I'll have to wait for my cheque. Am I just being impatient?0
