DCA Record Somebody Elses default on my file

HELP!!!

About a year ago I was being hassled by Buchanan Clarke and wells on behalf of phoenix recoveries.

They were trying to recover a debt from littlewoods catalogue from me.

I have NEVER EVER had any credit of any kind from littlewoods. I sent a letter to BCW asking to see the signed credit agreement and saying I did not acknowledge the debt, I complained to trading standards and to F.O at the time as they wouldnt even say who the debt was from.

the DCA's failed to provide any kind of agreement at all and I never heard anything else until I now see phoenix recoveries have recorded a default on my credit file.

what do I do?

Did you send a 12+2 day letter to BCW?

Did you get a default letter from Pheonix?

I sent a 12+2 letter to BCW they replied after this time saying they reffered it back to phoenix. that was last year...ive heard nothing from either of them since then, phoenix have not sent any correspondence at all. I dont have any default notice and i dont have a copy of any agreement at all let alone a signed one.

Personally - I'd contact the credit ref agency and lodge a dispute - I've had to do this and had it removed fairly easily. Make sure you state that you have never held any accounts with the original debtor and this has been incorrectly marked against your account. Also explain that you have asked them for a CCA to prove if it was your debt or so that you could further investigate if it might have been fraud however after the offical request on x date they have failed to provide this.

THEN send a copy to Phoenix or whoever registered the default and advise them that you want it removed immediately or you will contact the FOM and OFT and as this is likely to have a detrimental effect on your credit worthyness until it is resolved you will have no option but to seek damages and compensation. As you have already disputed owing this debt then they should never have placed a default

its says default date is 23/11/2006

Do a Tine suggests. Have you been refused any credit over the last few years?

I was refused a virgin CC but accepted by others. Its never been on my file until 25/01/2009

Make sure you mention this in your letter of complaint.

isnt it illegal for them to have recorded a default when they have neither complied to supplying a CCA or issued a default notice?
