With regard to IB medical reports being used to review DLA awards this can and does happen sometimes. I know this is a fact because it has been confirmed by a former welfare rights officer and ex-tribunal member. As ESA replaces IB I expect that this will continue.

Your situation sounds suspect to me, I have no knowledge of DLA. I don't know how you could advise people of their rights and not know your own. It is a shame that benefits get abused by people and the really needy face the problems caused by that. I hope it all gets sorted for you and if you are entitled to the DLA that you get it.0 -

However essentially it is the full story. As I understand the position someone complained that I was getting benefit and they thought I couldn’t because I was working and this is what caused the investigation to be initiated. What their position is in fat is that working is not compatible with an award of dla either in relation to the MH conditions or the physical ones . Now that may be understandable if I was doing a physical job. The work I did was in relation to housing advice (with an overlap in relation to housing benefit).
The first job I had was in fact providing telephone advice in the evening at home. I would receive around 4 calls a night so how that is incompatible is another matter.
I accept that there are many awards of dla where there are no problems but with the new rules and legislation it remains to be seen what happens.
I am going to do another post which will deal with things in a little more details.

Yes you are right, for example if someone fails their IB/ESA medical and they have a problem with walking and receive higher rate mobility component DLA their DLA award can be reviewed.0 -

I was a little confused by your posting. It is quite different when you are involved in something yourself as you can look it impartially. However the area I deal with is housing law.
I do not see why it is suspect. I guess to some extent you have to suffer from mental health issues similar to mine to fully understand the problem. The difficulty is that I suffered domestic violence albeit the emotional abuse type and by me having to recall it for tese case means that I remain a victim of it and can't move on at all.
