Well I accept that this can be a situation I only gave the example of one instance. There of course are many others and also others where the partner should be able to work in they choose. With regard to IB medical reports being used to review DLA awards this can and does happen sometimes. I know this is a fact because it has been confirmed by a former welfare rights officer and ex-tribunal member. As ESA replaces IB I expect that this will continue.

On another note this post by the OP is now running on at least 4 different forums on different websites on the internet which I do think is a bit excessive.

Just on 3 forums (1 was censored due to CCA) just wanted help to a large extent even if its just moral support.

Ok it was on 4 forums and now is on 3, not much difference really.

Your situation sounds suspect to me, I have no knowledge of DLA. I don't know how you could advise people of their rights and not know your own. It is a shame that benefits get abused by people and the really needy face the problems caused by that. I hope it all gets sorted for you and if you are entitled to the DLA that you get it.

there are no new rules for dla only icap is now esa for new customers.

what are these new rules and legislation?afaik there have been no recent changes in the rules for DLA

They are as you say totally different assessments,but(and i maybe wrong)i have read that the dwp can use any medical reports less than 6 months old when assessing any benefit

Yes you are right, for example if someone fails their IB/ESA medical and they have a problem with walking and receive higher rate mobility component DLA their DLA award can be reviewed.

I was a little confused by your posting. It is quite different when you are involved in something yourself as you can look it impartially. However the area I deal with is housing law.

I do not see why it is suspect. I guess to some extent you have to suffer from mental health issues similar to mine to fully understand the problem. The difficulty is that I suffered domestic violence albeit the emotional abuse type and by me having to recall it for tese case means that I remain a victim of it and can't move on at all.
