Kate you can get the loan cancelled but you have to hand back all the goods you bought ie plasma tv, playstation 3, ipod, designer clothes, handbags, shoes, rolex watches, ear rings etc.0

The whole concept of Unenforceable loans is somewhat of a moral paradox.
Is it right to get off on a technicality?
If the Tables were turned would a lender do the same?
On one hand my mind says if you borrow then pay it back, but on the other hand, seeing the way lenders treat customers and the methods they use to reposess, the Debt Collection Agencies harrasing people..
I have to say, its a tough call. But if It came down to me loosing my home or getting out of the loan due to a mistake by the lender, then I would take the mistake any day.
However, without cause, just for the sake of it trying to find a way out of paying something, then morally, I would probably not.0 -

That is not actually true. If a CCA is deemed to be unenforceable then the lender loses the right to recoup the initial capital and cannot reclaim the goods.
Precendence is already set on this issue. In other words, a decision has either been made by the House of Lords or an Appeal Court.
There are a number of issues where regulated CCA agreements will be deemed to be unenforceable if the lender does not fully comply to the law.I am a former Broker, former IFA and former compliance officer, for my sins.

If there is a loophole take it,do these footballers have a conscience when they get off a driving offence through a technicality there expensive lawer has found? or a murderer getting off because the paper work was not right?

Generally though - you take a loan, you PAY IT OFF!!!
What is with all these people trying to wriggle out of their responsibilities on some minor technicality?
Who are you to question people and pass judgement?
Maybe some people cannot cope with their debt like you can, maybe due to circumstances beyond their control. (You just DONT know, you have PRESUMED)
Wake up and smell the coffee, big companies have been screwing people on technicalities for years, look up there at the MSE banner. Notice the words 'consumer revenge' ???
I suggest you change the narrow minded, judgemental perspective you have on the world, you'll be happier for it. :rolleyes:

Kate-08 has posted to a web based forum which implies she has some knowledge of computers. However, she (he?) has not fathomed what a 'SEARCH' button is used for nor it would appear has heard of Google, Yahoo or many other internet search engines out there. If this is a genuine post then she should not be allowed out of the house without adult supervision much less get involved in anything financial0
