Confused over IVA

  • If she is no longer on the Individual Insolvency Register then she is no longer in an IVA (it probably failed).
    If it is a joint debt she and OH are both jointly liabl for all of the debt and if she doesn't pay they can pursue OH for all of it.

    Thanks. We guessed it was likely that the IVA had failed. But we wanted to check whether there would be any other reason why at least one of her creditors (don't know about the rest) isn't going to get a single penny!

    OH is just confused as the IP told him monies would be paid and some months later is now saying nothing will be paid for this debt. Obviously they can't give much other detail coz of data protection. OH is making regular payments to this debt though.

    If she has failed and her creditors don't make her bankrupt (she has no assets - council tenant, old car etc) - are they then likely to start pursuing the debts again? Or do they stay quiet?

    Anyone had this happen? :o

    Ok so two credit reports later.... he has a couple of defaults, some late payments...

    but nothing on there to indicate any IVA or anything else :confused:

    I'm fairly sure the CCA is correct, have checked and all payment terms, interest, full amount of loan etc is all on there.

    What next? How do we find out why at least one creditor is no longer going to get any money from the IVA???
