Private Car Parking Fine

Basically, someone went out shopping quite late at night about 11pm and came back and drove down the road twice and there was no space to park. So instead of parking on double yellow lines, the car was parked outside the co-op at the top of the road.

The co-op allows you to park there for 30mins, but on the sign does actually say you shouldn't park over night, however, the shop closes at 11pm.

The person got an important phone call and then completely forgot about the car being parked there until 8am the next day and went to move it. They had received a parking fine at 04:10am!!!

Any help would be greatly appreciated.

    Do NOT pay this, it is NOT a fine, only the courts can fine you, this is an invoice that is in no way enforcable. Just ignore it and any further correspondance you recieve from them. Don't appeal either, as this will just encourage them to send you even more letters.

    They are just expectin you to pay as it looks all official.

    May I re-iterate....DO NOT PAY!!!

    Hi Craig, welcome to MSE.

    That isn't a fine, it's an invoice, and an unenforceable one at that. Ignore the reply from "Millionaire" (above) which is wrong.

    If you take a look at the "welcome" sticky on the board, bargepole's posted some advice about private parking company (PPC) tickets.

    In a nutshell - ignore them. They'll send letters and later correspondence may have red ink/chequered borders to make them look official and intimidating.

    P.S: You can remove the images from the first post and reference to who may have been driving at the time :)

    That's outrageous. The OP has admitted blatantly flouting the parking regulations. Parked on private property for which there was a sign saying, if you park here for longer than I let you I'm going to fine you. He's then fined ... moans about it, and you tell him to ignore it.

    Let's hope he doesn't choose to park in your driveway next time!!!!!!

    I thought this was the Money Saving Forum?

    Did the OP cause the co-op to lose any money? - NO
    Did he break the law? - NO
    Did he cause any pain or suffering? - NO
    Did he cause an obstruction? NO

    So why should he pay a worthless invoice??

    If he had parked on the double yellows and got a ticket, I would say "tough, pay it" but he didn't. Wouldn't you feel the same if you got hit by one of these rip-off merchants??

    If Maxim Securities rejects the representation and the Registered Keeper is still not satisfied, they can appeal against the decision, the appeal will be dealt with by an independent adjudicator. The adjudicator will deal with the appeal by post or, if the owner requests at a personal hearing. The adjudicator's ruling is final. Details of the Adjudication Appeals procedure will be included in the letter of rejection.

    Who is this "independent adjudicator", I wonder? Who appoints him? And on what grounds does he have an authority to adjudicate? And who deems his decision to be final?

    I see they also refer to fines and call the invoice a Penalty Notice. All pretty much in contravention of the new consumer regulations, don't you think?

    Ignore it - This is not a ticket, offence or any form of regulation breaking. It is an entirely private invoice - although even that looks kind of suspect as well, although neilB can advise on that much better.

    You will probably get a few letters from them but the chance of it going to court is about nil & even if it does, the chance of it being upheld is slimmer still.

    DO NOT PAY this. They are using intimidation and blatantly illegal means to get money out of you. They are relying on you just paying it. DON'T.
