Shafted by T-Mobile

Sorry to be so blunt but it would appear that between my mobile provider (Mobile Express - Carphone Warehouse) and T Mobile I have been well and truly shafted for another 6 months. An offer too good to be true online with M.E. for a Nokia 6230 on Tmobile, 200 free minutes and 200 texts (1st six months) with free line rental for 12 months and £30 for another 6 months on an 18 month contract I thought, at the time was a good deal. I have been with TMobile for several years and had great service and coverage and as I have some difficuties the disability helpline have been extremely helpful. After six months on contract I contacted Tmobile to arrange my text needs and spoke to them about the contract and asked when the best time would be to call up to cancel the contract. I was told then that the contract would now be full rate but I could cancel at 12 months with no charge which effectively meant that I was paying the same. When I called tmobile yesterday I was told that if I want to cancel I had to pay a further £180 (six months contract rate) I have sent an email of complaint but really have little hope unless someone knows anything I can do to persuade them??

Not sure I understand the problem. It sounds like you took out a contract with 18mths commitment , which you have tried to cancel after 6 months. Therefore t-mobile are entitled to claw back the remaining 12 months rental of the 18 month contract

Sorry I don't understand either. You signed up for an 18 month contract and tried to cancel after 6 months, or am I missing something?

  • Just guessing but it sounds like the original deal was an 18month deal with 12 months free. After six months she was told that the free months had ended and she would now have to pay full monthly line rental but that the contract would now become a 12 month one. In effect it would not cost her any more than the original deal. However T-Mobile are now enforcing the original 18 month deal meaning she would have had to have paid 12 months instead of the stated deals 6.

Like i said just a guess but thats how i read it. I admit it took me a few reads to understand it.

Surely if it's 12 months free then somewhere along the line Mobile Express were offering cashback to make it 12 months free rather than T-Mobile, as far as T-Mobile are concerned teh contract is probably charged correctly at full price each month, it was cashback that makes it effectively 12 months free?

(again the post makes it very hard to understand where it has become a 12 month contract rather than 18 months)
  • Contract was for 18 months with 12 months free line rental - after six months T-Mobile started to charge FULL rate. Disability Helpline advisor in October 05 advised that the contract was for 12 months and could be cancelled in Feb 06. In Feb 06 when calling to cancel the contract the advisor informed me that contract was for 18 months and cannot be cancelled until July 06.

There may be two stages to this. Perhaps T!mobile gave the free 6 months to begin with, and maybe the rest of the reduction will be as a result of cashback from the dealer.

I think you need to speak to them both to clarify.

Sounds about right, some months are reduced by Tmobile and the rest is full price but claimed back with cashback from the retailer.

Just found a similar deal at e2save here is the blurb

12 Months FREE Line Rental on Relax 100 (18 month)

Bills 1,2,3,16,17 & 18 will be billed at £10.50* by T-Mobile. T-Mobile will then bill you at £21.00 per month for the remainder of your contract.

To gain the remainder of your line rental / cash back please send your 4th, 8th and 12th monthly bills within 30 days of the date stated on the relevant airtime bill, to us and we will credit you by cheque with £63.00 each time.

This will save you £252.00 over the 18 month duration of the contract. In effect this means that your average line rental per month over the contract period is £7.00 per month.

*Line rental charge excludes any part month amount that may be billed in addition by the network.

The best thing i would do is contact T-Mobile, ask for a copy of all data held by them relating to you under the Data Protection Act.

I would be sure when you have spoken witht his person who quoted contract could be cancelled in Feb 06 may have left notes to that effect. Therefore you may have an arguable case as you have been givn mis-leading information by your provider.

Failing that i would try and locate the original deal paperwork and check over the offer.

    Good luck
