I had claimed the RBS for my missold PPI I recieved a letter from them in July telling me that they had credited my account vwith £5663 which would go towards my loan I was happy with that although would have liked it in my hand.I am in a debt management plan just now,and I pay the monthly payments they have asked for.I recieved a letter on Saturday stating that they have credited my account with a further £714.32 that has cleared the arrears on my account and they are going to add a further £1,361.44 to my loan account.I have wrote to them this morning asking that I receieve the £1,361.44 they have stated in the letter that they have cleared my arrears I am making monthly payments through my debt managaement plan.Do you think I will receieve this money?I could really do with it leading up to Christmas.0

Hi weeang, its good to hear from you and well done to you.
Yes it would have been handy paid directly to you.
If there is a set plan made up, are you actually with a debt organisation?
And are they aware of your reclaim?
May I ask if that was more than what you owed on the arrears?
So there were a remaining amount?
If so what they could have done was cleared the arrears and refunded the remainder directly to you if this is the case.
Sorry if I have mis read on this.;)The one and only "Dizzy Di"0 -
Hi
I am with a debt management plan who took over my payments with my loan and a couple of other things. My payments were £375 per month and when I went into my dmp they reduced the payments to £271 per month I have been doing this for 19 months which means i was £1976 under what I should have paid. They said that if I had not been paying ppi my payments would have been £280 pm but they would not adjust the payments and I had just to keep paying the monthly amount. But as you can see there was over £5000 paud in July then the further £714 I think ishould be in fornt now and thats why I have asked for the rest to be paid to me,I dont know if because I am in the dmp that they have to pay it to the loan.
Thanks for your help again.0 -

Hi weeang,
Yes you have a point here, with it being the remaining left after paying the arrears.

Hi i received my SAR from Barclays however I do not believe I was given all that I should have been.
Can someone break down for me exactly what I should have received in my SAR... I have been sent a copy of my credit agreement and I can see what payments I have made and balances that are reducing but not by the amount of my payments, so obviously interest and charges are being applied but this is not shown at all.
So I really have no idea what is being done with my account and I believe it may involve unfair charges but can't work this out by the information I was sent, even the manger in Barclays bank can't believe they have only sent me this information.
The ICO has no agreed also that they did not act within the 40days it took almost 3 months!!!! and I have been advised to write Barclays a letter asking for more information but I need to know everything that I should be expecting before I do that.
many thanks

Hi Amy
Is the account still running?
And how long have you been running the account.
They should send information they hold on you going back as far as 6 years England/Wales and Scotland I believe is that of 5 years, so anything you have taken out with them in that time they should provide you with, if you don't think you have received everything as requested on the SAR, for example maybe transcripts of phone calls made etc, then you can if you want to write back about this.
I did post a template (SAR follow up letter) on here earlier, I will try to find it and post it for you.;)The one and only "Dizzy Di"0 -
Amy below is a follow up, this template I did actually copy and paste from another site of where I am a member, this should be okay.
Then if they cannot oblige to this, they should write back with an explanation on why they cannot supply the information for you.;)
(Date)
Dear Sir/Madam
Account Number: xxxxxxxx
You will be aware that on **/**/** (date you sent SAR) I sent you a Subject Access Request under the Data Protection Act 1998. This was sent recorded delivery and was delivered to you on **/**/** (date it was delivered to them) therefore on the **/**/** (date when 40 days expired) you should have provided me with all personal data relating to me as a data subject. You have failed to comply with my Data Protection Act Subject Access Request and therefore I have made an official complaint with the Information Commisioners Office and no doubt you will be hearing from them in due course.
If you do not comply within the next 7 days I shall seek a Court order obliging you to do so together with damages at the discretion of the Court and without any further notice.
I trust this clarifies my position.
Yours faithfully
