Hello...can anyone help me with this one. I am trying to reclaim my PPI back from Barclay, last letter they said No, they didn't think they has missold me the policy, but I could send for a copy of my agreement if I so wished.....so I did....on the 5th May 2009 I recorded it of course and have hear nothing back, only a letter form the debt collector saying he was about to take me to court for non payment :rolleyes: any suggestions, is it worth taking Barclays to court or the ombudsman, and cutting out the Bank and debt collector....how many times am I suppose to write to this Bank, that can't even answer recorded letters:mad: thanks if you can help.Lilly

I would ask in writing for your true copy of your agreement (CCA), they have 12 days and normally for this request they cost a £1 postal order or cheque payment, and of course to make sure they receive your request post by recorded delivery.
You could write back to them and tell them you want this reconsidered, if they have not suggested the Financial ombudsman service yet, otherwise do go straight to the FOS now.
The thing is here, you could lost money if you take to court, such as the fees involved, where the FOS are a free service, it is up to you, but if you could perservere with waiting to have your complaint investigated by the FOS, I'm sure they will resolve this for you, where you receive the whole lot back and possibly more if they also suggest Barclays to pay out a distress payment.

Hi, Di3004 and thank you for your response. I may not have worded my post clearly. I had topped up a loan just over two years ago for consolidation purposes. My bank told me that I had to have P.P.I. to get the loan. I desperately needed it at the time, so didn't query this. I am therefore well past the cooling period, with just under three years left to pay on the loan. I will obviously pay off the remainder of the loan over this time, but am about to write to the bank saying that I believe I was mis-sold this P.P.I., (in an indirect way, my bank have indicated this was the case at a recent visit). What I needed to know was can I start with the claim before trying to cancel the P.P.I. on the loan or should I tell the bank I wish to cancel the P.P.I. and then progress with the claim? Your advice is much appreciated.
Hi Blondie, not a problem, it was me I expect, so not to worry.;)
You can cancel the PPI the same time if you want to, basically on the reclaiming letter, just start by telling them you want the PPI cancelled immediately, and expect to pay lower repayments from the next payment due.
Then of course go on to tell them your complaint about this PPI and so on.

But it is up to you if you want to cancel this the same time, you can do this afterwards if you want to, but most cancel either before or the same time as the complaint.

Hi There, I'm actually in the middle of debate with The Funding Corporation regarding PPI because it was missold and also it was front loaded which I tried to go the FOS route but ws told they couldn't do anything because The Funding Corporation was not under the FOS duristiction, have a court case pending.0

Is it going to be difficult to work out whether they owe anything above the PPI payments paid plus interest without the settlement letter?
I have not sent a SAR on this just requested the Loan Agreement.
Perhaps foolishly they are already looking at my compliant. I just wanted to get an idea of what to ask for if I need to issue an LBA.

How long ago was it since you tried with the FOS?, as some are actually resubmitting their's back to them, due to these "Single mis sold policies", it may be worth you contacting them again just to make sure and make them aware that it have been mentioned that some cases of others have been resubmitted, good luck.;)The one and only "Dizzy Di"0 -

I called Lloyds TSB last week for a settlement figure and I found out that my loan has PPI, which is strange as i specifically said i didn't want that!! But i am considering going down a BR or DRO route so not sure whether i should say anything about this?!? What do you suggest?
Also if you have closed a store card/credit card which had PPI can you reclaim that? I dont think i have any account details for them anymore so it would be a case of calling and asking for them. Do you think there is any hope??

I would not worry about letting them know about this, your main concern in reclaiming back what is owed to you.

It makes no difference if the account is settled or still active, you can still reclaim.

They have 8 weeks in full to respond, keep at them until they resolve in your favour, or until they issue you with the final response, which should give you details of the Financial ombudsman service (FOS), you can take your complaint to these if your not happy with the outcome of your complaint.
