PPI Reclaiming Discussion part 4

Hello All.
I wrote in May 2011 to the bank asking for the agreement for the account , i already have the statements as i have already claimed back unfair charges on this account.
They did not reply.
I left a post on here asking what you think i should do and someone :Avery kindly got back to me saying that i ought to just send in the form (FOS form on here).
I sent in the form (FOS) at the begining of august and received a reply saying that they will look into it and get back to me.
Last week i received a copy (out of the blue, remember i asked for this in May) of the agreement and the PPI is not ticked. IT looks like they just added it without asking me.
This is a credit visa card account and i paid it off in full a couple of years ago. The PPI only appeard on my statements when the debt reached £4000. I do not remember being asked if i wanted the PPI and i was self employed at the time (still am) so not even sure if it was suitable for self employeds.
Will they still process my complaint? Or do i need to resend the FOS form?
Any advice would be greatly appreciated.
Thankyou
Had a succesful complaint in against Clydesdale Bank, Yorkshire's sister bank.
Looks as if you have valid reasons for your complaint especially since receiving your agreement, the bank should be able to complete your complaint within 8 weeks although it will probably be closer to between 12 & 16 weeks, from personal and other experiences, obviously you can go to FOS after 8 weeks and they should write to tell you this if they are taking longer. Also the letters always seemed to arrive roughly 6/7 days after the date of the letter, so say you're expecting a decision by the 10th September, it will probably be around the 17th before you receive it, I believe this is down to internal mail being slow.
After reaching the 12 week point I emailed the CEO and customer services.
Ceo: David.Thorburn@eu.nabgroup.com
PPI Customer Services: AQU.PPI@eu.nabgroup.com
Clydesdale and Yorkshire Banks weren't involved with the Judicial Review delays, so they aren't covered by the 16 week rule, or now it's the 12 week rule, this is what I used when I emailed the CEO.
Also when they were paying out they sent an acceptance form, with calculations and space for details of your preferred bank, once received payment was in the bank within 3 days, not too bad considering.
Good luck and keep us posted.
PS Just had a thought, sometimes the PPI is added when the card is validated over the phone, if they claim this, ask for the recording of the conversation about full and clear information that should have been supplied and explained to you, only need to do this if they try and use this excuse. Thanks to all the competition posters.0 -
TAX payable on PPI redress. Received money through from Clydesdale on Thursday, and in the letter we were advised to contact HMRC, I posted on Thursday about this, many thanks for the replies, OH contacted HMRC oin Friday and because she works full time and pays her tax through PAYE, her tax code will be adjusted to take the 20% tax from the 8% interest which was awarded(worked out just over £300 in tax to be paid) she was quite happy to do it this way and it left her with the money up front.
One big CC paid off in full also, freeing up about £150 a month, good result, also awaiting on five loan ppi with RBS for me, and one BOS CC ppi(the one just paid off in full) roll on October for those ones. Thanks to all the competition posters.0 -
Hi everyone
I just wanted to inform / warn people about using companies like Gladstone Brooks....I stupidly signed up for them to retrieve PPi that I had with First Plus. The PPi I had was for £15000.
I signed for a rate of 25% which I thought was high but did not know what the alternatives where?
The terms stated that GB would take 25% of the money refunded....I got an offer of £7440 cash and to wipe the £15000 from my loan which I thought was very good... I worked out the 25% off the £7440 I thought I had to pay GB and was left with approx £5500 after VAT. Ha Silly me...what GB neglected to inform me when signing was that they would take 25% of the total money received which included the £7440 and the £15000 removed from my loan....WOW..I was completely shocked that I had to now pay GB over £6000..I will say after talking with GB that they reduced the bill to £4500 so I would have a little cash sum for myself?
I am completely shocked and annoyed with myself that I was so stupid and got caught out.......please please if you are thinking about doing this, take further advice and guidance before you sign any contract with any of these companies advertising there services to recover miss sold PPi
I hope this advice helps some people not to make the same mistake as I have!!!!

Morning Nerul, well done on your claim...:j:j
Do you mind me asking, how long has it taken etc, as i have a front loaded ppi, which commenced in Oct 2008, i complained May 2011 & they blatantly refused the mis selling, so off to the FOS i went in June. The FOS said with the backlog it could be 9 months, i am trying to remain positive but it was a 5 page refusal letter stating like - eg: i had excepted it, i knew the terms etc, however, i have denied all this, furthermore, they sent me a CD of the conversation & i can be heard stating that we have brilliant employment cover, and additional private cover, but as i had never had a loan over £10, 000 before, what would they recommend ...and the sales lady states that it if it were her she would take the cover & it would be much better for us & the company if we took the cover - no T & C or costs were discussed otherwise i would of run a mile
:(:( so i will wait & see...i have hope as our good friends on here; Di, Amersall & niggly have said that front loaded ppi is the ppi that should be upheld as it is difficult to defend (dances)
:). Would be great to hear how you done it..congratulations :T:T:T:Txx
Hi Sunny and thanks for your congratulations !
Our loan went back to 2002 it was front loaded with over 23k of BLRI (though in all replies Lloyds TSB call it PPI). We settled the loan early after 27 months as we sold the business. At the time we were refunded just over 16k PPI but had been paying £208 a month during the duration of the loan.
We first complained to Lloyds back in 2009 and like you we had a five page refusal letter (but no CD) laying out the facts that they had done nothing wrong. We complained again and they refused again. We went to the FOS in September 2009 and had confirmation from them in July 2011 that our claim had been upheld. Our offer letter came yesterday. So in total it was with the FOS for two years! Nevertheless, I think you have a fantastic chance of getting back your money although it may take some time. From what I have researched front loaded PPI is difficult for them to defend. I wish you all the luck in the world as I know how worrying it is.:(
Even now I dont think my offer figures are correct. They have only given back the difference plus interest of what was paid up front and what was repaid. There is no redress for the 27 payments of £208.00. I will contact them first thing tomorrow.
Good Luck !0 -

Morning all,
I had a Natwest card that, due to some financial problems that I encountered, was passed on to Triton. I've almost finished paying Triton off, but I'm not sure whether the fact that i defaulted on payments to Natwest would preclude me from reclaiming PPI?
Any advice would be much appreciated.
Thanks.
Hi dazzler won't make any difference:cool:0 -
Hi D, I have placed a claim with Clydesdale/Yorkshire for loan PPI going back to 1994, they were relatively small loans..never over £4000, however, i have had to email several times...they never acknowledged my claim after 4 weeks, then just told me the usual 8 weeks..i emailed last week for an update to no reply
:( They dont seem the best of communicators...Good luck :T:Txx
