Send this letter to them ASAP.
We/I believe we were mis sold the ppi on the above account number.
1)We/I were not told that the ppi was in effect another loan that was added to the original loan and was repayable over the loan term with interest.
2) We/I were not told that the ppi only covered us for 5 years, but the ppi would still be on the loan to term end with interest.
3) We/I were told that if we did not make a claim on the ppi ,after 5 years we would recieve the ppi as cashback, and to look on this as savings plan.. But were not told that the ppi would be on the loan to term end with interest and the cashback of ppi would not include the interest that we paid over the 5 years.
In line with the FOS recommendations it is requested that the overall situation be restored as if PPI had never been included. This will entail:
a) A refund of the monthly payments that have actually been paid towards the overall loan in excess of those that would have been needed, if the original loan had been sold without the PPI policy;
b) Restructuring of the loan going forward so that the amount owed, the monthly repayments, the term and the charges reflect those that would have applied, if the original loan had been sold without the PPI policy.
c) In addition, interest at the rate of 8% simple per annum to any excess payments made from the time each payment was made to the point that Firstplus pays them back to us. We/i believe we were not given enough information on this ppi to make an informed decision. Had we/i known the full cost of this ppi we would not have taken it.
Unless you can prove without doubt that this PPI policy was fair, reasonable and suitable for my/our circumstances we/I will require you to rearrange the loan as if PPI had never been included on the aforementioned loan.

I am about to send a SAR to Barclays....do you think I should just send the template letter, or attach another letter explaining that I think I have been mis sold PPI?? ( although, they would have to be very stupid not to make the connection...):rotfl:

Right,this is what i would do,if you try this and get no joy then at least you will have tried.
First send an email to

Put what you have said here about the claims co and why this was allowed to get passed the 6 months to contact FOS.
Had you been given the information in time you would have followed this up with FOS,When the claims co folded you had already passed the timeline to take this further,you are dismayed that after having put the claim in again to FP they have rejected this due to the timescale.
Put you feel you are being treated unfairly by FP and think that due to circumstances beyond your control,you have now lost the chance of redress for this loan and are very disappointed with the way you have been treated.
Put that you will be sending a complaint to the FOS regarding this.
Then send the same email to FOS and stress this was beyond your control and could they help you in any way with this.

This has tobe another reason not to trust claims companies...I started a claim which had been handled by a claims company, who were closed down.
When I received my response, from those helpful people at Cap One..they said they had already declined my claim ( through the company, ) and that was an end to the matter....I had no idea until I got the correspondence from the bank..!:mad: So this is obviously going to come up later..my claim is now with fos...but it will be clear that my claim is outside the 6 month window..and all along I knew nothing!!
These companies are almost as bad as the banks...no contact, no updates...just take the money!0 -

Why are you doing a SAR? do you not have the account number?.
If you put a mis sell in then you do this as a claim on its own.they may have an idea with the SAR request methinks :rotfl:

Well, impatient IANC strikes again :rotfl:
How you guys that have waited years have coped I have no idea. (I have only waited 10 weeks).
Just called the chap at HSBC and the 9 PPI payments is correct as the CPI was added to my card after a telephone call in August 2007 :mad:
They are looking into whether they think interest should be added to the refund in respect of interest suffered whilst it was added to the card and then I shall receive a call. I think it will only be £30-£40 more, but that represents 13%-17% of the total claim and that money is better in my pocket than their's.
I just hope HBOS have their finger on the pulse as I can see me turning green and ripping my clothes off if I get anymore annoyed with them :rotfl:I'm a secret crime fighter0 -

I have a couple of loans from wa-a-y back..no idea of account numbers or anything, so thought I would need the SAR...
Just hope they ' fess up to previous accounts...I have been pleasantly surprised at posters here who have claimed on accounts from the nineties!

Right this is something that I should know really, but am vervous today in waiting for an opinion from the FOS in regards of a case that's been with them in almost 3 years.......so please bear with me for being dizzy today.........not that I'm any different any other day

I have just had a conversation with the manager of the complaints department and we have reached an amicable agreement :rotfl:
Basically, I told him that if we were to use the prevailing APR and take 9/12ths of it for the 9 payments, it would amount to just under £30, which it probably wouldn't as the first payment would be 9/12ths, the second one 8/12ths and so on.
He just said, shall I add £30 onto the £233 offer and call it quits
Yes please, email the remittance and I'll sign, scan and email it back.
Money will be in my account tomorrow.
