PPI Reclaiming Discussion part 4

  • I am currently in the middle of a complaint regarding PPI with my bank. I have just received a letter from the bank which says; to deal with the case more quickly they will make me an ex-gratia offer to bring the matter to a speedy conclusion. They will ensure that I am put back to the smae position that I would have een in had the PPI not been included with my credit card.

    I do not cmpletely understand what this means, would you consider it to be a good offer?

    Well done, looks like they are putting you back in the position as if you did not have ppi, check with them though, but that's how it looks.

  • Evening all...

    I would like to pick someones brain with regards to Egg PPI if I may...

    Back in 2007 I requested a loan from Egg via a telephone call but initially I was refused and then passed onto an underwriter who then said yes.

    I am pretty certain that the conversation went along the lines of 'If you dont take the PPI you cant have the loan' and having argued that it is something I have never taken out and having recently(2007) completed a prior loan with Egg without the need for it whatsoever, I do believe that it was removed and the loan granted... However, this loan came to term last September and a statement was issued from Egg showing all payments had been made on time inc PPI totalling £1700 over the 4 year term. This confused me as I was pretty sure I didn't take it out.

    I cannot find my original agreement and therefore I requested a copy from Egg, not forgetting to include a £1.00 cheque. Egg refused my request for a copy of my agreement as the loan had ended there was no legal obligation for them to provide it.

    Can anyone provide me details of what actions I can try to resolve this, because I have lost my agreement I cant confirm my actions...

    Thanks for the info. Did go to Santander this afternoon, the lady I showed the copy that was sent to me to one of the ladies there and she brushed me off by asking me to call their personal loans number, she did not want anything to do with it. So I called from their branch, and the guy I talked to on the phone and explained my problem told me to write another letter to them asking for another copy - can you imagine this, they are so unhelpful. To be honest, I find Halifax branch staff easier to deal with, and they will actually help you by emailing the department that is supposed to be dealing with the sending of such copies.

    So I will post another letter tomorrow requesting for another copy, hopefully this time round they will send the copy that is readable.

    Hi Chris

    Even though they are not obligated to provide the copy of the agreement, due to the account no longer active, you could optionally request a Subject access Request (SAR), they must comply to this and have 40 calendar days to do so.
    You enclose £10 cheque or postal order for this request.

    You could also request them to send you copy of the phone recordings, hopefully they still have a copy, this will then help your case if you believe they mis sold you the ppi.

    However, you can make a reclaim with your reasons without the need of the paperwork at this point, and you can try tracking down the loan account number on any bank statements, or if you bank online and still with the same bank where the monthly repayments came out of, this should allow you to go back quite a few years.
    The loan account/ageement number is normally shown next to the monthly repayment.

    To reclaim complete the reclaiming questionnaire as on stage one below link, send to the head office of whom set up your account, keep copies of everything in case you need to go back to this again at some point.

    They normally have 8 weeks but may request for longer time,

    Lloyds TSB Credit Card PPI

    I finally heard back from the FOS yesterday, my case has now been allocated an adjudicator- I spoke with her this morning; hopefully have the result next week.
    Just a few questions, I took out the credit card in 2001 and was duped into believing the PPI was like car insurance- a necessity. However in 2004 I moved abroad for 2 years, hence I was not a UK resident, am I correct in thinking that the PPI would be worthless?
    The adjudicator mentioned that when they reach their decision, depending what it is, Lloyds (and myself) have the option of appealing and request it goes before the Ombudsman. Has anyone any experience of this, whereby the adjudicator rules in your favour, but the bank appeals? If so what happens then in terms of whats the likely outcome and how long is it before the Ombudsman will review your case?

    Seems like you may have a good case, cos if i remember correctly your not covered if not in the UK, unless someone can clarify otherwise on this.
    That is procedure of the FOS, if they bank does not agree with the adjudicators decision, such as if the adjudicator have upheld in your favour, and the bank either ignores or does not agree, your case then will be forwarded to the ombudsman him/herself.

    Today I have completed the form to claim back my mis sold PPI loanguard insurance on an RBS loan. The question I have is that should I now call RBS and request that they cancel the PPI part of my loan agreement? Will this have any bearing on the claim that I have submitted today? Thanks
