Yes the enclosed a copy of the FOS leaflet.
Received second knockback from Lombard yesterday,which was a bit disapointing.
Before writing to them I contacted FOS who said they didnt think my claim was timed barred.
Now Lombard say that they have now also spoken with the FOS and agree that the claim is not time barred.
They however go on to say that they only came under FOS jurisdiction in 2007 and as such the FOS would not be able to consider my claim for an agreement / policy that came to in end in 2000.
I dont understand this as they were part of the Natwest bank at the time I took out the loan.
They go on to say that the documents I sent to them (copies of the original agreement and insurance policy) does not give them the opportunity to investigate how the insurance policy was sold to me or consider my claim any further.
They tell me to go to the FOS now if I am not happy .....after telling me earlier in the letter that the FOS have no jurisdiction in this particular case!
How frustrating these people are - its a game to them Im sure.
Any ideas where else I can take this?0 -

i phoned capital one last week to cancel my PPI as untill i came across this forum i thought it was just an extra charge that credit card companies charged and didn't really do much. When i cancelled the PPI they said they would investigate the policy as i could not remember asking for the PPI.
I have received a letter this morning along with my agreement saying that i ticked the yes box for the PPI cover :-( and i clearly have but the problem is, is that up untill six months ago i was unemployed for two years and never made a claim on the policy. so my question is would i be able to go back to capital one and say that i didn't need the PPI as all my payments over the two years were on time and i never missed a payment. any advice would be apprecitated thanks all :-)0 -

How frustrating, sorry to hear this.
Well I would then move on to the FOS and enclose the letter from Lombard that states this.
The FOS can still advise on the next best avenue where to take this, one of mine is through the underwriter/insurer instead and others on here have been advised of this direction.
Give the FOS another call next week, they will possibly advise that you send in all the copies of correspondence you received, and they will figure out on the next move.
There are ways around this.
Hopefully others who have been dealing with Lombard will post up and may have been in the same position as yourself here, and may have some useful advice but otherwise do continue with the FOS anyway - they will look into this for you.:)

Welcome.
Well I think you can try one or the two things here or both otherwise.
Write and explain "if you were aware that you were sold this policy, then you would have put in a claim for unemployment".
So its obvious you were not and for this reason you are making a reclaim now, tell them you assumed it was all part of the finance, because it was not explained to you otherwise.
(Do you know if the agreement was self bank ticked)?
Or write to ask if you could request for a back-claim (for this you will have to try to get all your info together, such as dates when you became unemployed (the job centre should hold these details for you, and also details from the employer).
Then if they refuse, then write back and request they refund what you have paid then, because its obviously been a worthless policy to you.
If they don't do any of this in your favour, then complain to the Financial ombudsman service. (FOS),

That is fine.
Some used to think it was something they had to sign and all inclusive of the loan etc/or credit card etc.
So it may have been you signed because you were just told to sign there and it was not discussed with you anyway.
Well if they are not a willing to back date the claim for unemployment, then yes you should request they refund all you have paid in ppi and interest because now its been worthless to you anyway.;)

The exact same happened to me.I have a loan with first plus,brokered through Loans.Co.Uk.lWhen I first approached First Plus regarding their unfair and mis sold PPI,they said it was nothing to do with them and told me to contact Loans.Co.,which have indeed gone bust and is now administered by the Bank of America.They gave me 12 phone numbers,yes 12 and one of them was indeed Money Expert,another number I tried was actually a chap sitting down to his dinner !!!!
I have had nothing but nonsense and fob off from Loans.Uk/Bank of America/First Plus and have handed the whole issue to the Financial Ombudsman and would advise you do exactly the same

"as your existing loan agreement has expired (passed the date by which it should have been re-paid) my offer is to apply the compensation as follows
£1648.26 will be used to clear your outstanding loan.
£867.17 will be sent to you by BACS
Now does that mean that the loan is completely settled and the £1648 was total of payments missed (which there were a few) and subsequent interest?
I'll ring them on Monday but would like a definite answer!
I'm inclined to say that it is but anyone else?:beer:0 -

The way I see it, is they have awarded what was missed on the arrears of the loan, and the remaining after clearing the arrears, they will send directly to you with interest, this is normally how it works if missed payments.
But do give them a ring on Monday and they will confirm.
