    Steve, sorry I forgot to say in my above post.
    Do not worry, we have all been there, and assumed that PPI was also all part of the finance.

    Now its payback time - to get your money back.
    The trick is to keep on at them, if they try fobbing you off then do not leave it lie, you got to show them that you mean business and not going anywhere until its resolved to satisfactory decision.;)

    I took out a £4k graduate loan with PPI in 2005 from Natwest while working on a fixed term contract, when the contract wasn't renewed at the end of 2006, my claim for loan repayments while unemployed was turned down as I hadn't had 2 contract renewals between taking out the loan and becoming unemployed.

    Although p'd off at the time, this was clearly written in the PPI terms, and I was fortunate to be able to manage the repayments before getting a new job. But having read the info on this site, do I have a case for having been missold the PPI? - it was clearly of no benefit to me when I was in need and had I been made fully aware of this (or had the nouse to work it out for myself?) I would not have made the choice to unnecessarily increase the total repayment value of my loan to over £6k (3 months to go til it's all paid off).

    In my opinion for your reasons as you stated - you do have a case.

    The policy was totally worthless to you and because of this, you were deprived of your money, where still paying for it and it has no use to you.

    So I would give it a go.

    1. Complete FOS questionnaire - shown on link below - further down the page as stage one.

    (these questionnaires were recently issued by the Financial ombudsman service (FOS) and on this site - in replacement of the first reclaiming letter.

    2/. Send to whom was responsible for selling you the product.

    3/. Keep a copy, this is recommended by the FOS.

    They have 8 weeks in full to respond with a decision - some request for extra time.

    And post by recorded delivery - this is your proof of posting.

    Hi everyone,

    Hope you are all ok.

    I wonder if anyone can give me some help.

    A friend took out a loan with the Halifax for £5000 and then topped up this loan. She is paying through a DMP and has no paperwork. Will she still be able to claim the ppi and how does she get copies of her agreements.

    Any help would be great.

    many thanks - fully intend on taking it all the way, just need to get it organised....so if anyone else is reading this then please follow my progress....just need to work out these damn figures !!!:-)

    She should be able to get copies of the agreement of the DMP form whatever company she is using if she requests them in writing, some companies request a token payment of £2 to cover P+P etc. The same applies to the bank, she just needs to ask for a copy of all statements and /or term and conditions of the loan etc. Make sure she asks for a copy of the details from when it was originally agreed as these sometimes change.

    After that I would imagine taking it to the FOS to see if she is eligible for a claim - hope this helps - good luck !!

    And yes your friend can still make a reclaim it does not matter if on DMP, and you still pursue the ones responsible for mis selling the ppi.

    The only issue is, if your friend is successful, they could possibly refund the ppi to the debt balance, but interest should be refunded directly to your friend.
    But this depends on how the company she is dealing with works.;)

    For this now, there is a Questionniare issued by the FOS, it replaced the first reclaiming template letter, check it out on the usual link Showergirl.

    The way I see it though, your friend should be successful in this reclaim, because she is still paying for something she is not able to make a claim on, for eg: sickness/unemployment, now its with DMP, its worthless to you. So I would mention this as well.

    An additional cover letter can also be done as well - to enclose with the FOS questionnaire, if your friend wants to give more information.

    PS:, your friend can request for a copy of the agreement from them, by enclosing £1 postal order or cheque, just write a simple letter, and request they supply by 12 days.
