Virgin Media 10 quid late payment 'fine' - legal?

Is the 10 pounds that Virgin Media charge you for late payment actually legal? How about other utilities companies that charge you a fine for late payment?
In these troubled times I can't believe they're still doing this, talk about adding insult to injury.
If the banks are illegally charging for late payments, then how on earth can these utility fines be legal?
They say it's to get people to move over to direct debit. Well, that would be great - if Virgin Media had it's act together with DDs. I've looked across the 'net and it seems people are regularly getting the 10 pound fine coming through even thought it's 'impossible' as they're on DD - as happened to me. In fact, not only did I have a direct debit in place, Virgin Media took my DD out TWICE on the same day. And then fined me 10 quid as it gave me the mistake payment back - but logged it as if I hadn't payed it at all.
However, my real question is, is the fining of utility customer actually legal.

Ofcom have looked into additional charges and have issued the following guidance."Sometimes you might miss a payment or your direct debit may fail andmuch as it costs for the provider to chase and collect late payments."
