i recived a pm from a member on here stating
"I work in a JC booking ESA appts & there has been some new guidance which came in to play from 15/12/08 - basically, if you are receiving high rate DLA for mobility & care, you are actually 'exempt' from the Pathways process"
dose anyone know if this is true as i get high rate moblity and care and was still asked to attend the interviews. i told the person at the interview i was getting high rate dla aswell. yet she still booked me onto another iterview

This is what i have been told also, there is approx 6 interviews, they can not force you too take work, just to discuss the possibility of preparing you to take work sometime in the future, interviews are approx 1 month apart, then no more for 3 years, or until you are next assessed.It is better to be hated for what you are than to be loved for what you are not.0

i was asked to something similar,I phoned up explained I have MS and unable to work,she then asked me if my benefits r ok I explained tht they were ,checked about 2 weeks earlier by SS. She accepted this and said she would put a note on my record so tht I would not get any further contact I recieve hi rate care and mobilitty, so may b what u ahve been informed aint 100% correcti recived a pm from a member on here stating

Yes, it is true!! Basically, if you get HR DLA you should be in the 'support group' (IB has changed to 'align' themselves with the same rules!!)
Get on to the JC (ESA adviser or DASO Team) & ask them to 'defer' any more WFIs until you know which 'group' you have been placed in. This decision follows the medical which you may (or may not - there is a huge backlog!) have had.
Do it tomorrow!!!Oops!! Should I have posted this??? Some users don't think I shouldn't be offering advice due to my occupation!!!

People who are currently on I/B may not be moved over to ESA till at the earliest 2010 and possibly longer than that0 -

Woodbine.... I never said that IB customer are being moved to ESA....
There is something called 'alignment' rules which are to do with WFIs.... JCs have been given the guidance since 15th Dec to bring IB customer's WFIs in 'alignment' with ESA - NOT the benefit.
Jemma-T - fortunately, in my office, we don't mind if someone comes on & questions what we are doing!!
ESA - I don't think anyone is 'scheming to get out of work' - if the rules have been decided by gov'ment then by customers should by all means make sure that those who should be carrying out these rules are doing so correctly. If someone is NOT required to attend, then it is their prerogative to ask!!??Oops!! Should I have posted this??? Some users don't think I shouldn't be offering advice due to my occupation!!!

i phone the job center and the man said i still have to attend the interviews. the only time you become exempt is after the medicle exam i told him i was on high rate dla and he said i still have to go.

Rubbish. Would you have to go if you had severe brain damage and couldn't walk? No. OK, you don't have severe brain damage and can walk (I assume) so work back from there. Tell them you are far too ill and they can visit you if they like or contact your doctor/consultant etc. You can't go to any exam either as you are too ill and become worse if you travel due to stress.i still have to attend the interviews
Tell them you want to but can't. Not won't, couldn't, might, should, maybe, but can't. These are subtle things and some spotty DWP numpty knows nothing as he's more interested in getting his teeth whitened.
I used to work for an IT department and logged (saved) all calls made to governement (HM Customs and the old Revenue) help lines and the amount of nonsense and !!!!!!!! spoken by CS staff was amazing. Many make it up as they go along and like to be keyboard lawyers. Yes, a lot of us are like that but we're not getting paid to do a job. Essentially, phoning the DWP etc is like phoning Sky TV. Sometimes they say one thing and sometimes they say something else.
They'll send you forms asking why you're not attending of course and they'll hopefully be looked at properly.0
