BUYMOBILEPHONES.COM RIP OFF...Help
I have recently excercised my 'right to cancel within 14 day period' on a contract through Buymobilephones.com. I returned the unopened phone record delivery well within the two week cooling off period. Initially when I filled out the online application form they asked for my credit card details for 'conformation of identity' purposes only. My direct debit was set up through my bank. So when I cancelled my contract I kept an eye on my bank account to make sure they did'nt try debit the first month. But unbeknowns to me they heve charged £30 as a cancellation fee to my credit card. As I did not give them permission to do this and they did not notify me of their intent are they allowed to do this? What are my legal rights as a consumer ?

If it was on your credit card you could phone up the card company and tell them its a fraudulent transaction. If your lucky, they will charge it back and the retail may well get penalized to boot.0

If it was returned under the Distance Selling Regulations, ie no later than 7 working days after receiving it I don't think they can charge any fee. However if it was after 7 days then I guess their own T&Cs would apply although I'm no expert. I would contact Trading Standards and ask them.0
