in regards to my sons bits, his granny will have the receipts for them but they were paid for in cash so theres no proof she actually purchased them.
as for provident, i was meant to pay 12 a week and got it down to 6 which again, some weeks i dont have,(i've put more on the gas this week so don't have the money for provvy). i'm gonna try for 3 pound now, when it is paid off i have no intention on ever using them again.
the main gripe is capquest though, as i am typing this they have rang again....demanding i answer security questions, which i wont do, then i get the threat of bailifs, but if they plan on making me bankrupt can they send bailifs too?

You might be able to get a loan to cover the provo loan from your local credit union.

They can make you bankrupt or they can go to court for a CCJ.
They do not want to do either, infact, they will do almost anything to avoid either of these options.
They thought the Statuatory Demand would get you to pay up, but if you do not have the money, you cannot. They are NOT going to spend £1500 making you bankrupt, knowing that you do not have anything they can take to repay the debt. Forget it, it does not happen.
With respect to the CCJ, it is a possibility but if youy are on benefits, they will be awarded £1 per month, as long as you defend the claim. So what is more use, harresing you to get a few more quid a month or doing a CCJ?
And as long as you keep paying the £1 per month on the CCJ, they cannot get the bailiffs involved. If you stop paying and do not responmd to the subsequent court papers or start paying agins, then they might get permission to bring in the bailiffs.
This is why you have to stop them phoning you.If you've have not made a mistake, you've made nothing0 -

Something along the lines of:

I do not acknowledge any debt to your company.
I am writing to you to inform that I request all communications to me in writing. I do not want any further telephone calls made to me.
To continue to contact me by telephone after I have requested you not to constitutes harassment. I require all future communications in writing for future Court use. Do not telephone me again – remove any telephone numbers you hold for me from your systems.
Your telephone calls are in breach of the Office of Fair Trading guidelines. If you continue with them after the receipt of this letter, an official complaint, together with a log recording the times and frequency will be passed both to that office and to Trading Standards, For your information, all telephone calls are taped.
This type of debt collection method is contrary to the ‘Administration of Justice Act 1970’. In that it is intended to cause alarm and distress to the recipient. Your methods will not be tolerated. A formal complaint to the relevant authorities will be made.
Take further notice that continued telephone calls after receipt of a request not to call may constitute a criminal offence under Section 127 of the Communications Act 2003. Continued phone calls may also constitute an offence under the Data Protection Act.
Communicate in writing and ONLY in writing. Your telephone calls will not be answered.
HOWEVER, CALLS WILL TRIGGER COMPLAINTS TO THE REGULATORY BODIES.

in regards to the letter above, i have aknowledge the debt though, when they first contacted me, last summer i think, i did panic at their intended actions and said i would make £10 a week payments, i have paid none though.
also i may add, i thought it was an old catalogue debt, looking back now it's SKY CARD who i originally owed, which was a credit card.Skint, but happy (ish):p0 -
