Definitely get in touch with trading standards, it's outrageous that Argos are doing this! >:(

Phone Argos back, speak to the manager and tell him if you dont get a refund on your card now you are taking legal advice. You might just scare them into doing something...!

I just pop in now and then.... :)

Yep, get back onto them and demand a full refund immediately. each time someone says no, demand to speak to their manager, and the next one up of they are not available. tell them you know your consumer rights and that you are entitled to an immediate refund as they have broken the terms of the contract to supply the goods.

be determined not to get off the phone til you've got the refund. they have already admitted that they have not sent you the goods. end of case.

take everyone's name before beginning to tell them the saga. if anyone mentions the goods incorrectly dispatched, then politely tell them that that has nothing to do with your order, and that you have no interest in their errors. blimey, if you gave someone too much change in a shop, does the next person in the queue have to wait til you get that back before he can have his change ???

    rediculous. dont accept it.

I think what I might do is order another one from somewhere else and see if I can get a few codes from here to get it cheaper, then call argos and say I want a full refund and that I have given my custom to another company.
Im so worried that by the time they pull they finger out and sort it they wont have any left in stock as I think they are big sellers this year.

If the top man is useless write to them saying that as they have not fulfilled the contract on their side i.e. delivering the goods to you within x days (what ever it said on site) they have breached the contract. You have been patient and given them reasonable opportunity to correct their error but they have failed to do so. As they have refused to refund the money they are now guilty of theft as there is no contract in place anymore so they have no right to hold your money. Given them just 2 days after receiving your letter to re credit your account else you will instruct a solicitor in the matter the cost of which you will recover from them.

Alternatively if you want the goods from them tell them you will sue for specific performance of the contract i.e. delivery of goods pronto (a local shop manager should arrange delivery of his stock to you as time is short). You will also expect to be compensated for the delay on their part and the cost of your phone calls etc (ask BT for cost of calls or look on bill).
