Yes it does - if you are on IS you will receive the maximum housing benefit this will either be at the LHA rate you are entitled to or the full rent less ineligible service charges if you are in a housing assocaition/ RSL property.

You are confusing what i said about the housing benefit with the actual rent liability. If your rent is more that the LHA in a private rental then yes you will have a shortfall.

e.g a single person on IS with a weekly rental liablility of £125 pw. LHA for a single person is £100 pw. He will receive £100 pw therefore full HB but will have a shortfall in his rent.

Obviously of you have non deps in the property that is different as there can be deductions etc

    EDIT

I also want to clarify that Local Housing Allowance is the rate set for a type of property. LHA dictates the maximum amount of the rent that can be met by Housing Benefit. It is always Housing Benefit that is awarded regardless of the rules surrounding its assessment - does that make sense? LHA and HB are not two separate awards, you are not awarded LHA your awarded HB. Sorry you probably all already know that. Getting myself in a tizz here ! Should get to bed i think ! :)
    :j
  • If she is claiming IS she should be also entitled to LHA. The op has 3 children which makes her ctc and cb payments quite high iyswim. She should be also entitled to Council tax benefit.

edit woodbine beat me to it

lol i`m getting quicker the nearer to 50 i get :rotfl:

h/b is different to lha,as council rents are assumed to be fair rents

The thing to remember is that every individual's situation is different. Although information given can be correct, people do not always know all of your circumstances, ie what, if any, NI contributions you have made, which will be an important factor. It is difficult for a person to work out how much they would get by themselves, although you might get a good idea using the benefits check.

The citizens advice bureau can do a benefits check and they will ask you relevant questions in accordance with your situation. They are in the phone book or you can google them. Website is: https://www.adviceguide.org.uk

    Hi,

I have been trying to work out how income support i will recieve but no luck.

    I am a single women or 36
child 1 is 17 in full time education
    child 2 is 4
    child 3 is 11 months

    No saving or child maintenance.

If anyone could give me rough idea i would be grateful thanks

You will recieve, income support for yourself, plus if you recieve any maintenance through the csa you will be allowed to keep £20 of any maintenance you recieve, on top of income support paid for yourself as a lone parent, child tax credit for each child, along with child benefit and you should recieve maximum hb and ctb too, but for accurate figures into the amounts i would contact the relevant departments.

LHA doesn't apply to council or housing assosciation properties.

To be clear about this, LHA is actually part of HB. LHA is simply the means by which the maximum amount that is payable for a private rent is arrived at. It replaces the previous system of Rent Officer decisions, which were based on a number of criteria. Rent Officer decisions were not applied to council or Housing Assoc properties either.
