annual leave entitlement taken away due to pregnancy illness........

hello all ,
to cut a long story short , i have been off work since i was 6 weeks pregnant due to threatened misscarriage (im now 29wks!!!!) and im still off , did go back for 2 weeks before xmas but had to go off again due to admittance to hospital , so once again im off , gp says its siatica !!! anyawy obvioulsly i have accumalated loads of annual leave , 19 days to be exact !!! i am now being told that they will let me carry 10 days over but i will lose the other 9 !!!!!!!!!!!!! this seems really unfair to me , does anybody know if there is anything i can do ???? or are they allowed to do this ???????? :confused:

  • as stupid as this sounds i dont know !!!! and ive been with them for 10 years !!!! and have very rarely been absent so never had to know !!! ha ha but they have told me that if i am still off sick then they can start my maternity leave 4 weeks before baby is due, im not sure if this is just regards to pregnancy related illnesses or any type of illness ????????? anyway obviously i cant take the holiday entitlement as im off sick !! our policy is that you can NOT be off sick and on holiday at the same time ,

    thanks for clearing that up !!!! ha ha , it just they tried insisting that my gp put pregnancy related illness on my sick note , my gp refused ,as she insists that it isnt !!! and i just wondered it this was the reason
  • They sound a bit sore about you having time off & they have to go to work in the wind and the rain and the cold and the dark...blah blah blah...

    My previous employer used to be civilised through gritted teeth when I was off/pregnant... it was a small company & she begrudged paying SMP & a wage to the person replacing me.
    Little did she know how thoroughly I research things... she was actually entitled to claim most of it back through the govt. & pretended like she didn't know... duh!
    Do your homework while you have the time off & chill... it's only work. :o

    I think most company policies don't let you be off on holiday/sick at the same time...

  • i work for the local council !!!!!!! that should explain it all !!! ah ha ha i just dont like to think im being ripped off , because believe me if they think they can get away with it , they will !!!!!! just wondered what others thought

    When you are off sick you can build up holiday, but this often changes when someone is on long term or indefinite sick leave, which is the case for you.

    Each company will have a different policy, but it's not uncommon for a company to stop holiday entitlement when people are off sick. The best thing you can do is ask them to send you a copy of their policy on long term sick and holiday entitlement. If you uncomfortable doing that, maybe a friend there could get hold of a copy for you?

    Because of this, I feel that the offer to carry some over is a fair offer, as some companies would not even allow this. The difference lies in the fact that you are pregnant. However, if your doctor is saying that it is non pregnancy related, then the above information stands true. You could get some advice from the CAB, but AFAIK there are no employment laws relating to what a company HAS to do, only guidelines.
