Notice to Owner received but no Penalty Charge Issued

Received the following NtO from Glasgow City Council with out Penalty Charge on windscreen or issued direct to me.

Loading car with a table from a shop across the road. Parked in a loading bay across the road from the shop.

Need to get pictures of loading bay next weekend.

Sent letter to council requesting copy of notice, photos and wardens notes (sorry not PC) etc.

Previously part of another thread - sorry I'm new to this posting/threads. Any info greatfully received.

    Yes good move - as long as it is not phrased like an appeal? any chance of seeing it? PM if you like.

    On the NtO - if identical to the one you earlier refferred to then yes - use the info when we get going.

    Your particular situation is interesting. Definitely loading but you also mentioned in the other thread a vehicle restiction. A point of some discussion as to what constitutes a 'goods vehicle'. Basically it could be most cars but there may be something specific in the Traffic Regulation Order for that location that limits it.

  • :hello: Looking on this forum and on PEPIPOO.COM it would appear that GCC have changed the wording on their NtOs to counter some of the previous threads.

    I have three options:

    1. Pay the reduced fine £30 (what I hear you say!)
    2. Plead with them as I was loading a heavy table at the time (what is a goods vehicle? Is a hatchback with the rear seats folded down, a vehicle for carrying goods or a burden?)
    3. Point out that they have failed to provide a copy of the original PCN and a computer print out is not sufficient. Also the NtO is factually incorrect>

    What would you do?

    As much as people are welcome to PM me there is certain info that will be important for all readers and you should post that response here really.

    You are now talking about 'appealing' tomorrow but they are saying something completely different. They have treated your request as an appeal but i have no idea what you said to them? Next they are proposing something hilariously outrageous - another NtO???? that alone could win it for you. It seems incompetence knows no bounds.

    Please do as I suggested for this one - post here but take it for opinion to PeP - cos many more clever minds and particularly some Scots interest.

    Good to hear but given your realisation that their 'fine' is illegal, there wasn't anything to rescind...

    OK - I've just fined you £200 for using this smiley: :j

    But because I'm nice I'm going to rescind the fine so you don't have to pay it. :p

    These companies make their money from people who pay after being intimidated by their lies and baseless threats. They don't 'do' court because they know they'd lose.

    Oops - apology due from a very silly Crab :o

    I assumed GCC referred to yet another parasitic private parking company (we've had quite a few PPC questions in the last week since the email tip went out).

    I realise now that you meant Glasgow Council so of course ignoring those sorts of tickets is not a sensible option. :o

    In my defence I was watching the F1 build-up at the same time and didn't actually read the first post at all. :o
  • My experience is not GCC but where I know in the UK, this is what should happen:

    If you have received an NtO but no ticket, but they have images of your car with the PCN affixed and/or your tax details, the notice will stand. However, you may be given some leniency and they might reinstate the discount if you didnt receive it (and this is the first time this has happened). Worth asking.
    If you were loading you will have to prove it, with a receipt for the table if it was new. You said a shop so hopefully you have this. If you were moving house a tenancy agreement might do it. Its even worth trying getting a second party such as the shop to confirm what was happenign, if you dont have a receipt but this isnt always accepted.
    Remember also that there should be recorded an observation time in the loading bay before the ticket was issued, check that this was given and was the right amount of time.
