Hi newbie here and after a little help please.
My girlfriend took out a contract with vodafone thru phones4you, as she was comming to the end of her contract and decided to cancel she rang vodafone to give here months notice, however vodafone say she is on a 24month contract.
Looking back through her paperwaork she has a signed copy of here contract that clearly shows she signed an 18month contract.
The contract was faxed through to vodafone however they are refusing to accept it, insisting that its a 24month contract.
Any help on what she can do would be very much appreciated.

    Hi,
Well done on keeping the paperwork.
Take it to Phones4u where it was taken out and get them to sort it.
Either that or a Vodafone store, much better to do these thing face to face.
If its there in black and white you should have no trouble

Check the tariff on her bills, most Vodafone tariffs have the contract length in the name i.e. 18M or 24M. If it shows 18M, then they are wrong, if it shows 24M then maybe the account was set up wrong. Suggest to Vodafone that you will send them a certified copy of the contract to prove it is 18 months and that you expect them to reimburse you for the certification. To get it certified you take the original contract to a 'Comissionar of Oaths' or Solicitor who can certifiy it as a true copy which you can then sent off. Otherwise if its a Vodafone contract take it to one of their shops and ask them to phone head office to confirm they have seen the original contract.

The bill duration code isn;t always right. I've only ever used 12 month contracts but had one where the bill said "18" even though they insisted it was 12. The original contract is all that really counts, not some arbitrary and unlabelled code on any bill.
  • Hi, i took out an 18month contract with vodafone in july 07 the deal was anytime 750 minutes+3000 texts+120mb internet for 45 pound a month. The phone i got was the first nokia n95 which i wanted for the sat nav as i am a lorry driver i phoned vodaphone previous to getting this contract to get the details and was told this was ideal for me as the maps are constantly upgrading i then went to a phones4u shop to get this the first month was fine but halfway threw the second month i had my calls stopped i phoned vodaphone to see why this was and was told i was at there limit even though i had hardly used the phone for calls i was then told it was for the internet use which i had not used the vodaphone rep asked me if i had been using the sat nav to which i said yes and was told that when my maps were upgrading this was internet usage i was then told i had a bill off over 300 pound which was about 2weeks worth i went straight to the phones4u store and myself and the manager phoned vodaphone after a very lengthy phone call i was told this money would be taken off my account and told me to deactivate the upgrading of my maps on my phone i was happy with this and my phone was switched back on after about a week my phone was switced off again so i phoned vodaphone to see why i was then told i had an outstanding bill of over 500 pounds i explained the situation and was told it would be sorted out after another couple of weeks i heard nothing and my phone was not turned on i phoned vodaphone yet again to be told by a very rude manager that it was my problem and i had to pay this amount straight away. i cancelled my direct debit straight away fearing they would take this large amount of money. During this whole situation i was never sent one bill from vodaphone not even a letter i tried to gain access online but because my line had been frozen i could not gain access about a month later i moved home and had no contact from vodaphone or anyone on there behalf on friday 6th of feb 09 i recieved a letter from a debt recovery agent saying i owe the 1046 pounds because of this debt from vodaphone has anyone got any information that can help me with this problem if so many thanks!!

You've got yourself into a right mess. I suggest citizen's advice burreau at this stage, plus a letter of complaint to Vodafone. Stopping the direct debit was a huge mistake - however justified and/or tempting at the time. You will now have problems with every other organisation who checks you for credit. You need to try to get Vodafone to reduce the bills and correct your credit history - but this won;t be at all easy. Vodafone are a complete pain with simple things - and this isn't simple. Also by cancelling the direct debit you will have lost the contract yet still owe them legally for the remainder of its duration.

None of this is good news - so I recommend you do seek help as suggested asap. If you have legal cover as part of your home insurance that might be useful for free legal advice and (if necessary) legal action - but the latter is very slow and you need help now.

Matty538: has your girlfriend changed her tarriff at any point during her contract? It is possible her original tarriff was for 18 months but if she has requested to change tarriff it is possible the new tarriff she selected was 24 months and so by agreeing to change it she was agreeing to extend her contract by a further 6 months. Of course, if this was the case she should have been advised of this at the time.
I accept no liability if you chose to rely on my advice.

Whatever CAB say check it elsewhere. They are not the best people for advice (I know despite the name) I have been advised twice before what I should do depsite the fact I went in knowing what to do and needed more advice on the course of action not wrong advice on what to do..
