    No, the rent is on the property, not the number of people living there. The HB simply means the Benefits people pay the rent for her, if there is a shortfall she will top up.

    Does your mother get Incapacity Benefit or DLA?

    Can I ask how long ago this was. How long have you had the house. Also, how old are you.

    I am sure the social has cut all the benefits. and only gets housing benefit and council tax benefit.

    this was the property nov 07 its on a 2 year fixed so after the 2 years are up i want it transfered out of my name.

    I think you need to go and see the CAB to be honest. I am going to have to ask too many questions but you'll need to take this information to them.

    First off the house being in your name means you will probably not get Housing Benefit or Council Tax benefits so your aunt was very naughty there knowing you lived at your mums - I guess she knew about the HB too.

    When your mum made the HB application you were living there (as an adult?) and she should have entered the amount you was earning as it should have be a joint application, you was bringing money into the house and it meant this should have been declared. As an adult you would have been expected to support the house if your mother did not earn much but you did. Do you see what I mean? They can go back for the full 6 years and claim this so this is why I think you need CAB help.

    Also, why was your mothers benefit money cut? Do you know? Do they not give her anything to live on or is she not entitled for some reason.

    If you are on a low income and need HB then I suggest you see if you can get your name removed from the property or your aunts' help in paying the rent - as it will be the house that stops you getting this help and thus affording somewhere to live.

    Also, you should have declared any income/loss from the house on April 2008 Self Assessment so you should see about getting this sorted ASAP. I do not know for sure about this, someone else can advise, I think you would have had to register as self employed to do this and there is a fine for not doing so. If your aunt is in the habit of buying houses as investments I think she has been very naughty to implicate you in all of this - I am guessing you are quite naive and have been swept along with it all. Do not blame yourself as I was young and naive at one time, just work on getting it sorted out for the future - we all have to live and learn sometimes.

    I think the aunt has been a bit more than naughty, she has taken advantage of this young man outrageously. I hope she's panicing now. She's presumably at least guilty of tax avoidance to say the least.

    Please dont worry too much, blue monkey has given you great advice and if yu follow this you wont go far wrong.

    AH, I get so cross when people take advantage of other family members in this way, especially ones that are naive and are not told of the implications things like this cause, all they can see if their own ££. It really does rile me.

    OP, please do let us know what happens and if we can help with anything else then please do ask. Chase up that benefit claim for your mum too. Please do not be afraid to ask for any help, especially try the disabilities & dosh boards as they will have lots and lots of advice for you.
