Gosh, what a mess. My mother was told that as he had interest in property she was not entitled to HB or CTB, likewise, there were some benefits she could not clain because she had equity in the house.
I think you need to speak to your aunt. I am not sure how old you are but you should have been declaring the earnings from this house on a tax return - I guess this is why your aunt did not want to do that herself, so she was not liable.

Situation is that my mum is in a care home because the hospital she was in sent her here for rehabilitation. I work and do not get any benefits and never have. I am on the tenancy but as the tenants son and I pay my rent every month. I am scared at the moment and do not know what to do. I am not sure as i have never been told that my mothers placement is permanant or not.0

WIth regards to the rental propertly it is let out to the social and they pay for the rent. I do not get involved with that side. But i should speak to aunt as I will have to declare it on tax return.0

As far as I know she is not permanant at this home/hospital unless the doctors know something that I don't. If she is not permanant would that make a difference?
Yes, because she would still need a home to come back to. There was a lady where we used to live, on her own, late 30's, in a 3 bed detached house and had mental health issues, she spent a year in a home/hospital but they could not move her from the property as she was not in a care home.
I think more than anything you will need to get this issue with the HB sorted as your mum should have declared what you was paying for your way. If your mum is in hospital she can still claim the HB as she is not working, but if you are on the tenancy then what you earn will be considered so bear this in mind. This is where it could get messy because of the property you have in your name. Do you have legal papers to say what happened or did they just give the money to you? That was quite naughty of your aunt to be honest as the full implications of this have clearly not been explained to you.0 -
OK. If you are on the tenancy you will be fine. Even if your mother was to need long term care and was not in the house anymore you will not be asked to leave so please do not worry about this, it is your home. It does not matter if you are using just the one room - when was we threatened with homelessness there were lots of single people in 3 bed houses and the HA could not ask them to leave. You will be fine there.
However, you will need to get the HB sorted out pretty promtly. At a guess your mum is on DLA/IB - or she should be, so if she is not getting the benefits she is entitled to then you need to help her with this now and get it sorted out. When she claimed HB you should both have gone on the form - because you are joint tenants (this is because you are not a child and it would be the same as married people applying) and so what you earn will make a difference to how much you get in benefits. How long have you been there?0 -

Yes, you need to sort this out. If you have interest in any property then you will not get benefits so if this house is not yours get your name off the deeds pretty quickly. The fact a joint tenant has interest in a property (if your aunt died tomorrow for example the house is in your name so it will be yours, how do you prove this is not your house - this is going to be very difficult to proce, also if your aunt is on HB/Benefits then she will not be entitled, if this why she passed it to you?) then it will mean your mum has to declare this.0 -
Also could someone tell me as its only me there would the rent be cheaper then 2 people living here and no housing benfit.0

First off, wny did your aunt put the house in your name and how long ago was this? Is she on benefits?

Yeh it is in my name as an investment. She is not on beneift she bought it for investments and it is let out to people who are on the social. She pays 40% tax.0
