Carphonewarehouse - return policy

Hi there,
I've just bought a PAYG phone with Orange in a Carphonewarehouse shop yesterday.
Today I realize that I don't actually like the phone.
So I went back to the shop and asked to swap the handset and pay the difference for a more expensive handset. The chap from CPW said that this was not possible - only if the phone was faulty they would swap against a phone of the same model. :confused:

Just got back home and looked through their return policy

14 Day Exchange If within 14 days of buying your mobile phone you are not entirely satisfied, we will be happy to change your phone, network or tariff, where permitted.* The original phone and accessories must be returned to us in an 'as sold' condition, with the original packaging, receipt and any items that were included in the purchase price, including promotional items. Exchanges are subject to stock availability and if there is a price differential, you will pay us the extra or we will reimburse you the difference in accordance with our refund policy.
*Notable exclusions to our 14 day exchange policy include upgrades on all networks, T-Mobile connections, and 'handset only' purchases. However, if you purchased through our website or Direct Sales, these exclusions do not apply and you have 7 working days from delivery to return your product for an exchange or refund.
If possible I would like to return the whole package and swap to a PAYG package with T-mobile.
Would you think that this is possible?

    Wrong forum, as socrates said. However, it's the 'as sold' part that you have not adhered to. I assume you have usd the phone... inserted you sim card into it, etc? Then it is not 'as sold', it is now 'used'.

    Take it back to the store and refer them to their 14 day exchange policy.

    See what they say, but expect them to use the excuse the product is not in an 'as sold' condition. Was the mobile in a sealed box when you purchased it? If so and you have broken the seal, I suspect they will say it's no longer 'as sold'.

    The mobile was not in a sealed box.
    Yesterday's CPW-staff put in the Orange-SIM-card himself saying that the package has to be sold like that.

    What about the cooling off period?
    The t and c are flexible. For example, I bought a mobile charger for £25 at cpw but returned it a few days later. I went to one shop and said that they would not provide a refund due to the t and c. I refused and went back to the shop where it was purchased and the manager gave me a cash refund!
    It is worth going back to the shop again to speak to the manager. Alternatively, a mobile phone is very fragile and so it could easily develop a fault within 28 days!

    Yes anytime I have bought a phone from CPW they have opened the phone and inserted the sim, some have even switched it on.

    So if you return it with it reset to factory settings it will be as sold.
